New Tolerance Exemption Petitions: W. Neudorff GmbH KG, Emmerthal, Germany proposes to establish an exemption from the requirement of a tolerance for residues of the molluscicide sodium ferric ethylenediaminetetraacetate (EDTA), in or an all agricultural commodities. Premier Horticulture, Quebec, Canada G5R 6C1, proposes to establish an exemption from the requirement of a tolerance for residues of the fungicide Bacillus pumilus GHA180 in or on all agricultural commodities and water systems when applied as described in the draft label. Amended Tolerance Exemption Circle One Global, Inc., Greensboro, NC 27409 proposes to amend an exemption from the requirement of a tolerance at 40 CFR 180.1254 to include a temporary tolerance exemption as part (c) for residues of the antifungal agent Aspergillus flavus NRRL 21882 in or on cotton.

9/29/10 Registration Review; Final Decision: This notice announces the availability of EPA's final registration review decisions for Capsaicin and Garlic Oil.
9/3/10 Cancellation Order Granted: This notice announces EPA's order for the cancellation of the product, Biter Fighter. The cancellation was voluntarily requested by the registrant, Ticks and Mosquitoes, LLC., EPA Registration Number 75771-1. Accordingly, the Agency hereby orders that the product registration is canceled. The effective date of the cancellation that is the subject of this notice is September 3, 2010. Any distribution, sale, or use of existing stocks of the product, Biter Fighter, EPA Registration Number 75771-1, in a manner inconsistent with any of the provisions for disposition of existing stocks set forth in Unit VI. will be a violation of FIFRA.
9/1/10 Experimental Use Permit Granted: EPA has issued an EUP (62097-EUP-1) to Fine Agrochemicals, Ltd., c/o SciReg, Inc., 12733 Director's Loop, Woodbridge, VA 22192. This EUP allows the use of 531 pounds of the plant growth regulator Prohydrojasmon (PDJ), propyl-3-oxo-2-pentylcyclo-pentylacetate, on 780 acres of apples to evaluate plant growth/ ripening. The program is authorized only in the States of California, Maryland, Michigan, New York, North Carolina, Oregon, Pennsylvania, Virginia, Washington, and West Virginia. 7/23/10 Tolerance Exemption Established: An exemption from the requirement of a tolerance is established for residues of Trichoderma hamatum isolate 382 in or on all food commodities when applied as a fungicide and used in accordance with
good agricultural practices.
7/14/10 Tolerance Exemption Established: In response to a petition from SummerSet Products c/o SciReg, Inc., EPA established an exemption from the requirement of a tolerance for residues of acetic acid, also known as vinegar in or on all food crops resulting from unintentional spray and drift to non-target vegetation including non-food, food and feed crops when used as a non-selective contact herbicide spray.

6/23/10 Conditional Registration Granted: This notice announces the Agency's issuance, pursuant to the provisions of section 3(c)(7)(C) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), of conditional registrations for the pesticide products, MON 89034 and MON 89034 x MON 88017, containing active ingredients that were not in any registered pesticide products at the time of their respective submissions.
6/16/10 Tolerance Exemption Requested: This regulation establishes a temporary exemption from the requirement of a tolerance for residues of Bacillus thuringiensis eCry3.1Ab protein in corn in or on the food and feed commodities of corn; corn, field; corn, sweet; and corn, pop, when used as a plant- incorporated protectant in accordance with the terms of Experimental Use Permit 67979-EUP-8. Syngenta Seeds, Incorporated submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting a temporary exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus thuringiensis eCry3.1Ab protein in corn under the FFDCA. The temporary tolerance exemption expires on June 1, 2012.

4/30/10 Registration Review; Biopesticides Dockets Opened for Review and Comment. This notice announces the availability of EPA's proposed registration review decisions for garlic oil and capsaicin Garlic oilis the volatile oil extracted from the bulb of the garlic plant or the entire plant. Garlic oil is used as a repellent for the control of insects, mites, birds, deer, rabbits and squirrels and is registered for use on terrestrial food and feed such as vegetables, fruits, nuts, and grains. Garlic oil is also registered for use on terrestrial non-food crops such as ornamental plants and shrubs. Capsaicin is a naturally occurring polymer that comprises the principal active element of chili peppers (genus Capsaicum).

Capsaicin is used as a fungicide, insect repellent and vertebrate animal repellent. Use sites are indoor and outdoor terrestrial uses. Applications are residential, commercial and when applied as a defensive repellent, circumstantial.
