12/20/00 Application for New Experimental Use Permit - EPA has received an application from Monsanto Company, of St. Louis, MO  for an experimental use permit for Cry2Ab protein and the genetic material necessary for its production (Vector ZMBK28L) in corn. (524-EUP-OU) The program proposes genetically contained non-food-use testing from October 15, 2000 to November 15, 2001 on a total of 11,394 acres in the States of Alabama, Arkansas, California, Colorado, Florida, Georgia, Hawaii, Iowa, Illinois, Indiana, Kansas, Kentucky, Louisiana, Maryland, Michigan, Minnesota, Missouri, Mississippi, North Carolina, North Dakota, Nebraska, New Mexico, New York, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Virginia, Wisconsin, and the Commonwealth of Puerto Rico. Experimental trials are to (1) breeding and observation nursery, (2) agronomic and efficacy trials, and (3) seed increase for further regulatory testing.

12/6/00 Issuance of Experimental Use Permit - 064500-EUP-1. Issuance. U.S. Department of Agriculture, Agricultural Research Service, Pacific West Area (PWA), Department of Plant Pathology, University of California, of Davis, CA. This experimental use permit allows the use of 25 gallons of the biochemical pesticide sucrose octanoate esters on 50 acres of grapevines to evaluate the control of glassy-winged sharpshooter during post harvest. The program is authorized only in the State of California. The experimental use permit is effective from September 15, 2000 to December 15, 2000. This is a non-crop destruct EUP.

8/30/00 New Active Ingredient Conditionally Registered: This notice announces Agency approval of applications submitted by AgraQuest, Inc. of Davis CA, to conditionally register the pesticide Bacillus subtilis strain  QST 713 A new active ingredient not included in any previously registered products
8/30/00 Petition for Temporary Tolerance Exemption (PP-8G05008) EPA has received a pesticide petition  from Platte Chemical Company, Inc.,  Greely, CO  to establish temporary exemption from the requirement of a tolerance for the biochemical pesticide 2, 6-diisopropylnapthalene (2,6-DIPN). In the Federal Register of 9/22/99 , EPA issued a rule establishing a temporary exemption from the requirement of a tolerance for residues of 2,6-DIPN. The temporary exemption from the requirement of a tolerance will expire on September 22, 2000. This request for temporary exemption from the requirement of a tolerance is associated with an experimental use permit (34704-EUP-13). 2,6-DIPN is a potato sprout inhibitor and the purpose of the experimental program is to test the efficacy of the active ingredient.
8/30/00 Petition for Tolerance Exemption (PP-0F6148) EPA has received a pesticide petition  from Ironwood Clay Company, Inc., c/o Plant Sciences Inc. Watsonville, CA  proposing to establish an exemption from the requirement of a tolerance for the biochemical pesticide Oceanic Clay. Oceanic Clay is proposed for use as a crop protectant and growth stimulant on agricultural crops. For growing plants, it works as a crop protectant by forming a barrier on the plant surface.
8/30/00 Petition for Tolerance Exemption(0F6136) EPA has received a pesticide petition from Plant Products Co. Ltd., Brampton, Ontario, Canada, proposing  to amend 40 CFR part 180 to establish an exemption from the requirement of a tolerance for the microbial pesticide Pseudozyma flocculosa in or on all raw agricultural commodities (RAC).
8/30/00 Experimental Use Permit Amendment (524-EUP-91) This notice announces receipt of an amendment to experimental use permit (EUP) for the Bacillus thuringiensis Cry1Ac protein and the genetic material for its production (vector PV-GMBT01and vector PV-GMBT02) in soybean from Monsanto Company. Notice of the original issuance of this EUP was published in the Federal Register on June 22, 2000 [See below] The new program proposes to increase the acreage by 22.0 acres and adds test sites in Hawaii and Puerto Rico. All soybeans will be grown under containment procedures. Plant material and seed produced will be destroyed or used for experimental purposes only.

6/22/00 Experimental Use Permit Granted  524-EUP-91. Monsanto Company, St. Louis, MO  This experimental use permit allows the use of 60.7 grams of the insecticidal Bacillus thuringiensis Cry1Ac protein in seeds shipped containing the plant-pesticide (Bacillus thuringiensis Cry1Ac protein and the genetic material for its production (Vector PV-GMBT01 and Vector PV-GMBT02) in soybean) on 61.3 acres of soybean to evaluate the control of soybean looper, stem borer, and velvetbean caterpillar. The program is authorized only in the States of Alabama, Arkansas, Georgia, Illinois, Indiana, Iowa, Kansas, Louisiana, Maryland, Mississippi, Missouri, North Carolina, and Tennessee. The experimental use permit is effective from May 25, 2000 to May 31, 2001. This permit is issued with the limitation that all treated crops will be destroyed or used for research purposes only.

4/19/00 Application for New Experimental Use Permit.  EPA has received an application for an Experimental Use Permit (67986-EUP-E)  from AgriPhi, Inc. of Ogden UT AgriPhi, Inc. seeks to continue their ongoing EUP program by requesting a 2 year experimental use permit to further evaluate the effectiveness of AGRIPHAGE (a bacteriophage) under normal production conditions for its control of bacterial speck of tomato (Pseudomonas syringae pv. tomato) and bacterial black spot of tomato/pepper (Xanthomonas campestris pv. vesicatoria). Testing will be conducted in the states of Arizona, Florida, Georgia, Kentucky, New Mexico, and South Carolina on a total of 2,810 acres. Approximately 200 pounds of the active ingredient or 10,000 pounds of the formulated product will be used for testing.

EPA has received an application from Mycogen c/o Dow Agrosciences LLC,  Indianapolis, IN , for an extension/amendment of their EUP for Bacillus thuringiensis Cry1F protein and the genetic material necessary for its production (plasmid insert PHI8999) in corn plants (68467-EUP-2). Notice of the original issuance of this EUP was published in the Federal Register on 5/5/99 (64 FR 24161) (FRL-6078-2). The new program extends testing to March 31, 2001 and adds 2,240 acres. Field testing is to take place in: Hawaii, Illinois, Indiana, Iowa, Minnesota, Nebraska, and Puerto Rico. Experimental trials are to involve agronomic observation and model validation for pollen shed phenology.

3/2/00 Petition for Tolerance Exemption EPA has received a pesticide petition (0F6078) from Mycogen Seeds c/o Dow AgroSciences LLC,  Indianapolis, IN  proposing, pursuant to section 408(d) of the Federal Food, Drug, and Cosmetic Act (FFDCA), 21 U.S.C. 346a(d), to amend 40 CFR part 180 to establish an exemption from the requirement of a tolerance for the plant-pesticide Bacillus thuringiensis subspecies aizawai Cry1F protein and the genetic material necessary for its production in plants in or on all food commodities.

BioRegulators, Inc., IR-4 Project Rutgers University, Cook College.  This experimental use permit allows the use of 72 kilograms each year of the biochemical phospholipid plant growth regulator Lyso-PE (lysophosphatidylethanolamine) on 570 acres of apples, citrus, cranberries, grapes, nectarines, peaches, pears, strawberries, and tomatoes to evaluate ripening and extended storage shelf life. The program is authorized only in the States of Arizona, California, Florida, Massachusetts, Michigan, Ohio, Washington, West Virginia, and Wisconsin. The experimental use permit is effective from June 3, 1998 to June 1, 2001.

BioRegulators, Inc., IR-4 Project Rutgers University, Cook College, This experimental use permit allows the use of 72 kilograms each year of the biochemical phospholipid plant growth regulator Lyso-PE (lysophosphatidylethanolamine) on 570 acres of apples, citrus, cranberries, grapes, nectarines, peaches, pears, strawberries, and tomatoes to evaluate ripening and extended storage shelf life. The program is authorized only in the States of Arizona, California, Florida, Massachusetts, Michigan, Ohio, Washington, West Virginia, and Wisconsin. The experimental use permit is effective from August 18, 1998 to June 1, 2001.
3/1/00 Experimental Use Permit Granted 34704-EUP-13. Issuance. Platte Chemical Company of Greeley, CO 80632. This experimental use permit allows the use of 5,000 pounds of the plant growth regulator 2,6-diisopropylnapthalene on 300 million pounds of stored potatoes to inhibit sprouting. The program is authorized only in the States of Idaho, Maine, Minnesota, North Dakota, Oregon, Washington, and Wisconsin. The experimental use permit is effective from September 28, 1999 to September 28, 2000. A temporary tolerance has been established for residues of the active ingredient in or on stored potatoes.

2/25/00 Application for Experimental Use Permit.  On February 9, 2000 EPA published a Federal Register Notice of the receipt of an application 68467-EUP-2 from Mycogen c/o Dow Agrosciences LLC requesting an experimental use permit (EUP) for the Bacillus thuringiensis Cry1F protein and the genetic material necessary for its production (plasmid insert PHI8999) in corn plants. The Agency has determined that the application may be of regional and national significance. Therefore, in accordance with 40 CFR 172.11(a), the Agency is soliciting comments on this application.
2/25/00 New Active Ingredient Conditionally Registered: Agrobacterium radiobacter strain K1026 - On September 28, 1999, EPA registered Agrobacterium radiobacter strain K1026 for control of crown gall on nonbearing almond, apricot, cherry, nectarine, pecan, walnut,  caneberry, and 2 ornamentals (62388-1) - from Bio-Care Technology
2/17/00 Comment Period Extended.  On February 17, EPA published a Federal Register Notice that EPA is reopening the comment period for the Agency's notice of 12/22/99 (64 FR 71753) . The notice announced receipt of an application submitted by Monsanto Company, to register the pesticide product Corn Rootworm Protected Corn Hybrids, (EPA File Symbol 524-LRA) containing a new active ingredient Bacillus thuringiensis Cry3Bb protein and the genetic material necessary for its production (Vector ZMIR14L) in corn for full commercial registration on corn.  The original comment period ended on January 21, 2000. In response to a request, the comment period is being reopened until March 20, 2000.
2/9/00 Application Withdrawn.  On February 9, EPA published a  Federal Register Notice that Agrium U.S., Inc., has withdrawn its application to register a pesticide product containing the active ingredient Burkholderia cepacia strain Ral-3 (EPA File Symbol 70724-R). The application is withdrawn without prejudice to future filing for registration of products containing Burkholderia cepacia strain Ral-3.
2/9/00 Application for Experimental Use Permit.  On February 9, 2000 EPA published a Federal Register Notice of the receipt from Monsanto Co. of St. Louis MO. of Experimental Use Permit Application 524-EUP-OR requesting an experimental use permit (EUPs) for the Bacillus thuringiensis Cry1Ac protein and the genetic material necessary for its production (Vector PV-GMBT01) in soybean.  The Agency has determined that these applications may be of regional and national significance.
