12/24/08 Registration Review Docket Established - EPA is opening the public comment period for a registration review of Atonik plant growth regulators (sodium 5-nitroguaiacolate, sodium o-nitrophenolate, and sodium p-nitrophenolate). EPA is also announcing that it will not be opening a docket for Ampelomyces quisqualis and for Candia oleophila because these pesticides are not included in any products actively registered. Comments are due by February 23, 2009.
12/24/08 Registration Review Decision - This notice announces the availability of EPA's final registration review decisions for the pesticides Chitin/Chitosan (case 6063), Farnesol/Nerolidol (case 6061) and Nosema locustae (case 4104).
12/24/08 Notice of Approval to Register New Active Ingredients: EPA issued a notice, published in the Federal Register of August 27, 2008 (73 FR 50613-50614) (FRL-8373-8), which announced that BASF Corporation, P.O. Box 13528, Research Triangle Park, NC, 27709, had submitted an application to register the pesticide product, n-Tetradecyl Acetate Technical Pheromone, Straight Chain Lepidopteran Pheromone (EPA File Symbol 7969-EIE), containing n-tetradecyl acetate at 99.56%. This product was not previously registered. The application was approved on December 4, 2008, as n-Tetradecyl Acetate Technical Pheromone (EPA Registration Number 7969-282 for manufacturing use.

11/28/08 Experimental Use Permit Requested: EPA is announcing the receipt of a Mycogen Seeds request for an Experimental Use Permit for the plant-incorporated protectants Bacillus thuringiensis (Bt) Cry1A.105 protein and the genetic material necessary for its production (vector PV-ZMIR245) in MON 89034 corn, Bt Cry2Ab2 protein and the genetic material necessary for its production (vector PV-ZMIR245) in MON 89034 corn, Bt Cry3Bb1 protein and the genetic material necessary for its production (vector PV-ZMIR39) in MON 88107 corn, Bt Cry34Ab1 and Cry35Ab1 proteins and the genetic material necessary for their production (vector PHP 17662) in Event DAS-59122-7 corn, and Bt Cry1F protein and the genetic material necessary for its production (vector PHP8999) in Event TC1507 corn. 11/19/08 Amendment to Exemption from Tolerance: EPA has received a pesticide petition 8F7319, from Summerset Products, 130 Columbia Court, Chaska, MN 55318, proposing to amend the existing tolerance exemption in 40 CFR 180.1258, for residues of the biochemical acetic acid when used as an herbicide applied to commercial and residential crops.
11/19/08 Tolerance Exemption Granted: This regulation establishes an exemption from the requirement of a tolerance for residues of the polyoxin D zinc salt(zinc [[2-amino-5-o-(aminocarbonyl)-2-deoxy-L-xylonoyl]amino]-1-(5-carboxy-3,4-dihydro-2,4-dioxo-1(2H)-pyrimidinyl)-1,5-dideoxy-[beta]-D-allofuranuronatein) on almonds, cucurbit vegetables, fruiting vegetables, ginseng, grapes, pistachios, pome fruits, potatoes and strawberries when applied/used as a biochemical pesticide to control and suppress fungal diseases. 11/05/08 Experimental Use Permit Granted EPA - has issued an EUP (264-EUP-143)to Bayer CropScience LP, 2 T.W. Alexander Dr. Research Triangle Park, NC 27709. This EUP allows the use of the plant incorporated protectants Bacillus thuringiensis (Bt) Cry 1Ab and Bt Cry2Ae (insecticides) on 1,919 acres of cotton. The active ingredients are described on the permit labels and summarized as follows: 0.02022 pound (9.18 gram) of Bt Cry2Ae active ingredient in cotton events GHB119 and cotton event GHB714. 0.05883 pound (26.709 gram) of Bt Cry1Ab x Bt Cry2Ae (Twinlink) active ingredient in hybrids of cotton events T303-3 and T304-40 Bt Cry 1Ab with cotton events GHB 119 and GHB714 Bt Cry2Ae. This EUP is intended to evaluate the control of Cotton bollworm (Helicoverpa zea), tobacco budworm (Heliothis virescens), pink bollworm (Pectinophora gossypiella), fall armyworm (Spodoptera frugiperda), and beet armyworm (Spodoptera exigua). The program is authorized only in the States of Alabama, Arizona, Arkansas, California, Florida, Georgia,Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, Texas, and the United States Territory of Puerto Rico. The EUP is effective from September 1, 2008 to December 31, 2010.

10/29/08 Conditional Registration Granted - EPA issued a notice, published in the Federal Register of May 30, 2007 (72 FR 29999) (FRL-8131-7), which announced that Syngenta Seeds, Inc., 3054 Cornwallis Road, P.O. Box 12257, Research Triangle Park, NC 27709, had submitted an application to conditionally register the pesticide product, VipCot, Plant-Incorporated Protectant (EPA File Symbol 67979-O), containing Bacillus thuringiensis Vip3Aa19 (vector pNOV3001) and modified Cry1Ab (vector pNOV4641) insecticidal proteins and the genetic material necessary for their production in VipCot cotton containing active ingredients not included in any previously registered product. The application was conditionally approved on June 26, 2008, as VipCot Cotton (EPA Registration Number 67979-9). The product is a plant-incorporated protectant for use on cotton.
10/29/08 Notice of Approval to Register New Active Ingredients - EPA issued a notice, published in the Federal Register of May 16, 2008 (73 FR 28466) (FRL- 8363-1), which announced that [Bedoukian Research, Inc.; 21 Finance Drive, Danbury, CT 06810-4192, had submitted an application to register the pesticide product, Bedoukian e,e-9,11-Tetradecdienyl Acetate Technical Pheromone, a straight-chain lepidopteran pheromone (SCLP) (EPA File Symbol 52991-EE), containing 94% of the active ingredient 9,11-tetradecadien-1-ol, 1-acetate, (9E,11E). This product was not previously registered. The application was approved on August 5, 2008, as Bedoukian e,e-9,11-Tetradecdienyl Acetate Technical Pheromone (EPA Registration Number 52991-22) for incorporation into end use products intended to control the Light Brown Apple Moth (LBAM).

10/08/08 Experimental Use Permit Granted - In response to a petition from Bayer CropScience, EPA has granted an experimental use permit, effective August 28, 2008 to January 31, 2009 permitting cotton plants genetically engineered to produce Bacillus thuringiensis for protection against lepidopteran larvae. This EUP allows the use of 0.02 pound of the plant-incorporated- protectant, Bacillus thuringiensis Cry1Ab protein in events T303-3 and T304-40 cotton plants, on 88.5 acres (out of 303 total acres) planted to Cry1Ab-containing cotton to evaluate the control of lepidopteran larvae such as bollworm (Helicoverpa zea) and tobacco budworm (Heliothis virescens). The program is authorized only in the States of Arizona, California, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Texas, and in Puerto Rico. The EUP is effective from August 28, 2008 to January 31, 2009.
10/02/08 Tolerance Exemption Granted - This regulation establishes an exemption from the requirement of a tolerance for residues of the fungal active ingredient Aspergillus flavus NRRL 21882 on the food and feed commodities of corn: Corn, field, forage; corn, field, grain; corn, field, stover; corn, field,aspirated grain fractions; corn, sweet, kernel plus cob with husk removed; corn, sweet, forage; corn, sweet, stover; corn, pop, grain; and corn, pop, stover when applied/used as an anti-fungal agent to displace aflatoxin-producing Aspergillus flavus from treated commodities. Circle One Global, Inc. submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Aspergillus flavus NRRL 21882.

9/24/08 Final Rule - Food Packaging Treated with a Pesticide - EPA is issuing a final rule which excepts from the definitions of 'pesticide chemical' and 'pesticide chemical residue' food packaging (e.g. paper and paperboard, coatings, adhesives, and polymers) that is treated with a pesticide. This final rule excepts food packaging materials (e.g. paper and paperboard, coatings, adhesives, and polymers) from the definitions of ``pesticide chemical'' and ``pesticide chemical residue'' under the Federal Food Drug and Cosmetic Act (FFDCA) section 201(q), when such food packaging materials have been treated with a pesticide regulated under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). This final rule expands the scope of the current exception which applies only to food packaging impregnated with an insect repellent - one type of pesticide. This final rule, as with the rule it amends, only applies to the food packaging materials themselves; it does not otherwise limit EPA's FFDCA jurisdiction over the pesticidal substances in or on such products or limit FDA's jurisdiction over substances subject to FDA regulation as food additives. This rule eliminates duplicative FFDCA jurisdiction and economizes federal government resources while continuing to protect human health and the environment. It is important to note that under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA), EPA will continue to regulate the food packaging as an inert ingredient of the pesticide product and regulate the pesticide active ingredient in the treated food packaging under both FIFRA and the FFDCA (except as otherwise provided by statute). The text of this final rule is identical to a direct final rule EPA issued on December 6, 2006. EPA received several comments opposing that direct final rule and therefore withdrew the rule on February 2, 2007, consistent with EPA policy. EPA issued a subsequent proposed rule on April 6, 2007 for additional public comment.
9/17/08 Registration Review Decision - This notice announces the final registration decisions for Linalool (case 6058) and Trichlorderma species(case 6050). The dockets for registration review of these pesticide cases include the final registration review decision documents as well as other relevant documents related to the registration review of the subject cases. Proposed registration review decisions were posted to the docket and public comments were requested. During the respective 60 day comment periods, no public comments were received.
9/10/08 Tolerance Exemption Granted - EPA has issued a Final Rule which establishes a temporary exemption from the requirement of a tolerance for residues of the Bacillus thuringiensis Cry2Ae in or on cotton and its food and feed commodities when used as a Plant-Incorporated Protectant (PIP) in accordance with the terms of [an] Experimental Use Permit. The petition was submitted by Bayer CropScience LP. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus thuringiensis Cry2Ae. The temporary tolerance exemption expires on December 31, 2012 and took effect on September 10, 2008 with objections and hearing requests due to EPA by November 10, 2008.

Chenopodium ambrosioides near ambrosioides, an insecticide and acaricide - EPA is seeking comments on a petition by AgraQuest, Inc. to establish an exemption from the requirement of a tolerance in or on all food commodities.

Laminarin, a pesticide - EPA is seeking comments on a petition by SciReg, Inc. care of Laboratoires Goemar SA, to establish an exemption from the requirement of a tolerance in or on all food commodities.

7/16/08 Tolerance Exemption Granted - EPA has issued a Final Rule for Genetically Engineered Corn containing Bacillus thuringiensis Cry 1A.105 protein in corn, exempting it from the requirement of a tolerance. Residues of Bacillus thuringiensis Cry 1A.105 protein in or on the food and feed commodities of corn; corn, field; corn, sweet; and corn, pop, are exempt from the requirement of a tolerance when the Bacillus thuringiensis Cry 1A.105 protein is used as a plant-incorporated protectant in those food and feed corn commodities.
7/09/08 Tolerance Exemption Granted - This regulation establishes an exemption from the requirement of a tolerance for residues of the ammonium salts of higher fatty acids C8-C18 saturated; C8-C12 unsaturated on in or on all food commodities when applied for the suppression and control of a wide variety of grasses and weeds. Falcon Lab, LLC submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of ammonium soap salts of higher fatty acids 8-C18 saturated; C8-C12 unsaturated). This regulation is effective July 9, 2008. Objections and requests for hearings must be received on or before September 8, 2008
7/09/08 Registration Review Docket Established - EPA has established a registration review docket for Trichoderma species and linallol and is opening a public comment period on the proposed registration review decisions. 7/03/08 Application for Experimental Use Permit - Genetically Engineered Cotton Varieties. EPA has announced the receipt of a Bayer CropScience Pesticide Experimental Use Permit for Bacillus thuringiensis Cry2Ae protein and the genetic material necessary for its production (pTEM12) in Event GHB 119 or GHB 714 cotton plants and the Bacillus thuringiensis Cry1Ab protein and the genetic material necessary for its production (pTDL004 or pTDL008) in Event T303-3 or T304-40 cotton plants. In some protocols, Cry 2Ae will be used with the previously registered Bacillus thuringiensis Cry1Ab protein. Comments must be received on or before August 4, 2008.

7/02/08 Tolerance Exemption Granted - EPA has issued a Final Rule for Genetically Engineered Corn containing Bacillus thuringiensis Cry2Ab2 protein, which establishes an exemption from the requirement of a tolerance for residues when used as plant-incorporated protectant in the food and feed commodities of corn; corn, field; corn, sweet; and corn, pop. Monsanto submitted the petition. The rule took effect on July 2, 2008 with objections and hearing requests due by September 2, 2008.

Box 28, Shellman, GA 39886-0028, proposes to amend the exemption from the requirement of a tolerance in 40 CFR 180.1254 for residues of the fungicide Aspergillus flavus NRRL 21882 in or on the food commodity corn.

Amendment to Existing Exemption from Tolerance - PP 8G7320. Montana Microbial Products, 510 East Kent Ave., Missoula MT 59801 proposes to amend the temporary exemption from the requirement of a tolerance in 40 CFR 180.1269 for residues of the fungicide,Bacillus mycoides, isolate J, in or on pecans, potatoes, sugar beets, tomatoes, and peppers.
6/13/08 Notice of Approval to Register New Active Ingredients - EPA issued a notice, published in the Federal Register of May 18, 2005 (70 FR 28524) (FRL-7706-5), which announced that Codena, Inc., c/o of Landis International Inc., P.O. 5126, Valdosta, GA 31603-5126, had submitted three applications to register the pesticide products, FACIN TECHNICAL, FACIN 25 EC, and FACIN 50 ME for use as biochemical insecticides and acaricides (EPA File Symbols 81978-R, 81978-E, and 81978-G respectively), containing Extract of Chenopodium ambrosioides var. amcrosiosdes. Subsequent to the Federal Register notice of May 18, 2005, the applications were transferred to Agraquest, Inc., 1540 Drew Avenue, Davis, CA 95618. FACIN 50 ME was withdrawn and the remaining product names were changed. The manufacturing use product, QRD 406 (EPA Registration Number 69592-21), and the end use product, QRD 400 (EPA Registration Number 69592-22), were approved on April 16, 2008. The end use product QRD 400,containing the new active ingredient Extract of Chenopodium ambrosioides var. ambrosioides, is for use as an insecticide and acaricide to be applied to field and container-grown non-food ornamental plants in commercial nurseries, greenhouses, and lath- and shade houses.;
6/13/08 Tolerance Exemption Granted: Aberdeen Road Company d/b/a Hercon Environmental submitted a petition to EPA for an exemption from the requirement of a tolerance is established for residues of (Z)-7,8-epoxy-2-methyloctadecane on all food and feed crops that occur when it is used to treat trees, shrubs, and pastures and such use results in unintentional spray and drift to non-target vegetation including non-food, food, and feed crops. 4/25/08 EPA Publishes White Paper on StarLink Corn Risk in the Human Food Supply - This notice announces the availability of a final White Paper that reviews data on the level in the human food supply of Cry9C protein from StarLink[reg] corn grain. The final White Paper concludes that the Cry9C protein has been sufficiently removed from the human food supply to render the level of risk low enough that continued testing for the protein in yellow corn at dry mills and masa production facilities provides no added public heath protection.

4/16/08 Tolerance Exemption Requested: EPA has received a petition ( PP 7F7186 ) from Falcon Lab, LLC., 1103 Norbee Drive Wilmington, DE 19803, (petition submitted by Forster and Associates Consulting, LLC, 230 Steeplechase Circle, Wilmington, DE 19808), proposing to establish an exemption from the requirement of a tolerance for residues of the biochemical pesticide, ammonium salts of higher fatty acids [C8-C18 saturated and C8-C12 unsaturated], in or on all food commodities. EPA issued a notice in the Federal Register of August 8, 2007 (72 FR 44521) (FRL-8139-7) to exempt ammonium salts of higher fatty acids from the requirement of a tolerance. However, the Food Quality Protection Act (FQPA) Publicly Releasable Summary was not present in the Docket. Therefore, EPA is republishing this notice to allow for public comment period on this action.

The Agency has determined that the application may be of regional and national significance. Therefore, in accordance with 40 CFR 172.11(a), the Agency is soliciting comments on this application.

Registration review is EPA's periodic review of pesticide registrations to ensure that each pesticide continues to satisfy the statutory standard for registration, that is, the pesticide can perform its intended function without unreasonable adverse effects on human health or the environment. Registration review dockets contain information that will assist the public in understanding the types of information and issues that the Agency may consider during the course of registration reviews. Through this program, EPA is ensuring that each pesticide's registration is based on current scientific and other knowledge, including its effects on human health and the environment. EPA is also announcing that it will not be opening a docket for registration review case 6060, thyme herbs and ground sesame plant because these pesticides are not included in any products actively registered under FIFRA section 3. The last federally registered thyme herbs (PC Code 128894) and ground sesame plant (PC Code 128970) products were cancelled for non-payment of the required annual maintenance fees of 2005 and 2006, respectively (August 3, 2005; 70 FR 44637; FRL-7726-4 and August 2, 2006; 71 FR 43748; FRL-8079-6).
3/28/08 Temporary Tolerance Exemption Established : EPA has established a temporary exemption from the requirement of a tolerance for residues of the biochemical pesticide S-Abscisic Acid,(S)-5-(1-hydroxy-2,6,6-trimethyl-4-oxo-1-cyclohex-2- enyl)-3-methyl-penta-(2Z,4E)-dienoic Acid in or on grapes when applied or used as a plant regulator in accordance with the terms of Experimental Use Permit 73049-EUP-4. Valent Biosciences Corporation submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting the temporary tolerance exemption. This regulation eliminates the need to establish a maximum permissible level for residues of S-Abscisic Acid, S)-5-(1-hydroxy-2,6,6-trimethyl-4-oxo-1- cyclohex-2-enyl)-3-methyl-penta-(2Z,4E)-dienoic Acid. The temporary tolerance exemption expires on October 1, 2010.

3/19/08 C8-C10 n-carboxylic acids (octanoic acid, nonanoic acid, and decanoic acid), insect repellent - EPA has received a petition (PP 8F7317) from Stratacor Inc. to establish an exemption from the requirement of a tolerance for residues on beef and dairy cattle, and horses. Stratacor Inc., 1315 South 46th Street, Bldg. 154,Richmond, CA 94804, proposes to establish an exemption from the requirement of a tolerance for residues of the insect repellent, [C8-C10 n-carboxylic acids (octanoic acid, nonanoic acid, and decanoic acid)], in or on food commodity beef and dairy cattle, and horses.
3/06/08 Experimental Use Permit Amended - Monsanto Company has developed an insect-protected soybean, MON 87701, that produces the Cry1Ac protein to provide protection from feeding damage from certain lepidopteran pests. The 524-EUP-1 application is for 133.10 acres of MON 87701 and 156.52 acres of non-plant-incorported protectant and border acres for plantings through July 31, 2009. A total of five trial protocols will be conducted, including: Agronomic yield trials, breeding and observation nursery trials, regulatory trials, product characterization and efficacy trials, and product development trials. States involved include: Alabama, Arkansas, Georgia, Illinois, Indiana, Kansas, Louisiana, Maryland, Mississippi, Missouri, North Carolina, Oklahoma, Puerto Rico, South Carolina, Tennessee, Texas, and Virginia.

1/30/08 Tolerance Exemption Requested EPA is soliciting comments on a petition from Syngenta Seeds, Inc. to establish an exemption from the requirement of a tolerance for residues of the plant-incorporated protectant, Bacillus thuringiensis modified Cry1Ab protein containing an additional 26 amino acid 'Geiser motif' in all crops and agricultural commodities.
1/30/08 Experimental Use Permit Amended - This notice announces receipt of an application 264-EUP-140 from Bayer CropScience requesting to amend and extend the existing experimental use permit (EUP) for the Bacillus thuringiensis Cry1Ab protein and the genetic material necessary for its production in event T303-3 and T304-40 cotton plants. Under the existing EUP, plantings are permitted through May 1, 2008. Bayer CropScience is now proposing to extend the experimental program until January 31, 2009 and to amend it by conducting testing with up to 0.018 pounds of Cry1Ab protein and the genetic material necessary for its production in events T303-3 and T304-40 on 88.5 acres (out of 297 total acres) planted to Cry1Ab-containing cotton. The Cry1Ab protein is effective in controlling lepidopteran larvae such as bollworm (Helicoverpa zea) and tobacco budworm (Heliothis virescens), which are common pests of cotton. The proposed program will be carried out in the States of Arizona, California, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Texas, and Puerto Rico. The proposed experimental program includes insect efficacy trials, and the evaluation of herbicide efficacy, agronomic performance, and breeding lines. Also proposed is the production of seed blocks to evaluate seed production,dissemination, and dormancy, and for harvest for future experimental field trial plantings.
