12/29/04 Petition for Tolerance Exemption - EPA has received a pesticide petition [2E6381] from Interregional Research Project, Project Number 4 (IR-4), Technology Centre of New Jersey, Rutgers University, New Brunswick, NJ proposing to amend 40 CFR part 180 to establish an exemption from the requirement of a tolerance for the biochemical pesticide sodium metasilicate in or on all food commodities.

New Active Ingredient Approval

1. EPA issued a notice, published in the Federal Register of March 28, 2002, which announced that Thermo Trilogy Corporation of Columbia, MD had submitted an application to register the pesticide product, Olive Fly Attract and Kill (A&K) Target Device, an olive fly attractant (EPA File Symbol 70051-TA), containing 12.8% ammonium bicarbonate and 0.2% dioxaspiro-5,5)-undecane (Spiroketal). This product was not previously registered. The application was approved on June 10, 2004, as "Olive Fly Attract and Kill (A&K) Target Device for Commercial Olives" (EPA Reg. No. 70051-76) and "Olive Fly Attract and Kill (A&K) Target Device for Ornamental Olives" (EPA Reg. No. 70051-96) for control of olive flies in olive orchards.

2. EPA issued a notice, published in the Federal Register of May 8, 2002, which announced that AgraQuest, Inc, of Davis, CA had submitted an application to register the pesticide product, QST 2808 Technical (later renamed QST 2808 MUP), as a fungicide (EPA File Symbol 69592-A)), containing spores of B. pumilus strain QST 2808. This product was not previously registered. The application was approved on October 14, 2004 for two products: The end use product Sonata ASO (EPA Reg. No. 69592-13), containing 1.38% of active ingredient by weight, for control of various fungal diseases on crops; and QST 2808 MUP (EPA Reg. No. 69592-6), containing 1.42% of active ingredient by weight, for manufacturing the end use product.

3. EPA issued a notice, published in the Federal Register of August 28, 2002, which announced that Natural Plant Protection, c/o Technology Science Group, Inc., of Goodyear, AZ had submitted an application to register the pesticide product, Biomite, a mite attractant (EPA File Symbol 70057-R), containing 0.417% citronellol. The product also contains three other registered active ingredients: Geraniol (2-trans-3,7-dimethyl-2,6-octadien-1-ol), Nerolidol (3,7,11-trimethyl-1,6,10-dodecatrien-3-ol), and Farnesol (3,7,11-trimethyl-2,6,10-dodecatrien-1-ol). This product was not previously registered. The application was approved on April 20, 2004, as BioMite (EPA Reg. No. 70057-1) for use against mites on agricultural crops, ornamental plants, and in professional landscape settings.

Active ingredient: Bacillus thuringiensis Cry3Bb1 protein and the genetic material for its production (Vector ZMIR39) in MON 88017 corn (OECD Unique Identifier: 88017-3). Proposed classification/Use: None.

2. File Symbol: 524-LLE. Applicant: Monsanto Company. Product Name: MON 88017 x MON 810. Plant-incorporated protectant. Experimental Use Permits Granted - EPA has issued the following EUPs:

524-EUP-96. Extension/Amendment. Monsanto Company of St. Louis, MO. This EUP allows the use of 2.8 pounds of the plant-incorporated protectant Bacillus thuringiensis Cry3Bb1 protein and the genetic material necessary for its production (vector ZMIR39) in corn on 2,530 acres of field corn in Alabama, California, Colorado, Hawaii, Illinois, Indiana, Iowa, Kansas, Kentucky, Maryland, Michigan, Minnesota, Mississippi, Missouri, Nebraska, New Mexico, New York, North Carolina, Ohio, Pennsylvania, Puerto Rico, South Dakota, Tennessee, Texas, Virginia, and Wisconsin. This EUP allows the use of 0.94 pounds of the plant-incorporated protectant Bacillus thuringiensis Cry34/35Ab1 proteins and the genetic material necessary for their production (from the insert of plasmid PHP17662) in corn on 1,177 acres of field corn in Arizona, Colorado, Delaware, Hawaii, Illinois, Indiana, Iowa, Kansas, Kentucky, Maryland, Michigan, Minnesota, Missouri, Nebraska, New Jersey, New York, North Dakota, Ohio, Pennsylvania, Puerto Rico, South Dakota, Tennessee, Texas, Wisconsin, and Vermont. The EUP is effective from April 29, 2004 to April 30, 2005.

29964-EUP-5. Extension/Amendment. Pioneer Hi-Bred International of Johnston, IA 50131-0552. This EUP allows the use of 3.97 pounds of the plant-incorporated protectant Bacillus thuringiensis Cry34/35Ab1 proteins and the genetic material necessary for their production (from the insert of plasmid PHP17662) in corn on 4,690 acres in Alabama, Arkansas, California, Colorado, Delaware, Georgia, Hawaii, Illinois, Indiana, Iowa, Kansas, Kentucky, Maryland, Michigan, Minnesota, Mississippi, Missouri, Nebraska, North Carolina, North Dakota, Ohio, Pennsylvania, Puerto Rico, South Dakota, Tennessee, Texas, Washington, and Wisconsin. Conditional Approval of New Active Ingredients

1. EPA issued a notice, published in the Federal Register of December 31, 2001, which announced that MycoLogic Inc. of Victoria, BC, Canada, submitted applications to register the pesticide products, CP-PFC 2139, a manufacturing use product, for the formulation of an end-use product (EPA File Symbol 74200-R) and Chontrol Paste (EPA File Symbol 74200-E), containing the active ingredient Chondrostereum purpureum isolate PFC 2139, at 1.68% and 0.67%, respectively. These products have not previously been registered. The applications were conditionally approved on September 23, 2004. Products containing the active ingredient Chondrostereum purpureum strain PFC 2139, for the manufacturing use product CP-PFC 2139 (EPA Registration Number 74200-1) and for the end-use product Chontrol Paste (EPA Registration Number 74200-2), for control of alders, aspen, and other hardwoods in rights-of-way and forests.

2. EPA issued a notice, published in the Federal Register of December 24, 2003, which announced that Woodstream Corporation of Lititz, PA had submitted an application to conditionally register the pesticide product, Animal Repellent Granular, animal repellent (EPA File Symbol 50932-RN), containing the active ingredients Oil of Black Pepper at 0.48% and Piperine at 0.185% as active ingredients not included in any previously registered product. The application was conditionally approved on March 18, 2004 for the end-use product as Animal Repellent Granular (EPA Registration Number 50932-10) for use as an animal repellent.

12/22/04 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the microbial pesticide Bacillus pumilus GB34 when used as a seed treatment in or on all food commodities. An exemption is also granted for such residues on treated but unplanted soybean seeds. Gustafson LLC submitted a petition to EPA to amend and expand an existing exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus pumilus GB34.

11/03/04 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the Bacillus pumilus strain QST 2808 in or on food commodities when applied/used in accordance with label directions. AgraQuest, Inc submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus pumilus strain QST2808.

10/27/04 Objection to Tolerance Exemption Denied - By this order, EPA denies the objections filed by the Truth In Labeling Campaign (TLC) and additional citizens to a final rule issued June 21, 2001. That rule exempts from the requirement of a tolerance under section 408 of the Federal Food, Drug, and Cosmetic Act (FFDCA) use of L-glutamic acid (LGA) and gamma aminobutyric acid (GABA) on all food commodities when applied/used in accordance with good agricultural practices. EPA is denying the objections because the Agency has evaluated these products and believes them to meet the statutory requirement of reasonable certainty of no harm.
10/27/04 Application for New Active Ingredient - EPA received an application as follows to register a pesticide product containing an active ingredient not included in any previously registered product. File Symbol: 67979-L. Applicant: Syngenta Seeds, Inc., Field Crops-NAFTA, of Research Triangle Park, NC. Product Name: Event MIR604 Rootworm-Protected Corn. Plant-incorporated protectant. Active ingredient: Modified Cry3A protein and the genetic material necessary for its production (via elements of pZM26) in Event MIR604 corn SYN-IR604-8. Proposed classification/Use: None.
10/27/04 Petition for Tolerance Exemption - EPA has received a pesticide petition (PP 4F6838) from Syngenta Seeds, Inc. of Research Triangle Park, NC proposing to establish an exemption from the requirement of a tolerance for the plant-incorporated protectant (modified Cry3A protein and the genetic material necessary for its production) in corn.
10/13/04 New Active Ingredient Approval
1. EPA issued a notice, published in the Federal Register of August 11, 2004 which announced that HBB Partnership of Fresno, CA had submitted an application to register the pesticide product, California Red Scale Technical Pheromone, a manufacturing use product for the formulation of a mating-disruption pheromone end-use product, (EPA File Symbol 75108-E), containing the active ingredients (3S, 6R)-3-methyl-6-isopropenyl-9-decen-1-yl acetate and (3S, 6S)-3-methyl-6-isopropenyl-9-decen-1-yl acetate at 36% and 22% by weight, respectively. This product was not previously registered. The application was approved on September 15, 2004, as California Red Scale Technical Pheromone (EPA Registration Number 75108-2) for use in manufacturing or formulating.
2. EPA also issued a notice, published in the Federal Register of August 11, 2004 which announced that HBB Partnership had submitted an application to register the pesticide product, Red Scale Down, a mating disruption pheromone end-use product, (EPA File Symbol 75108-R), containing the active ingredients (3S, 6R)-3-methyl-6-isopropenyl-9-decen-1-yl acetate and (3S, 6S)-3-methyl-6-isopropenyl-9-decen-1-yl acetate at 0.041% and 0.025% by weight, respectively. This product was not previously registered. The application was approved on September 15, 2004, as Red Scale Down (EPA Registration Number 75108-1) for the control of California red scale in citrus.

09/30/04 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of Bacillus thuringiensis var. aizawai strain PS811 (Cry1F insecticidal protein) and the genetic material necessary for its production in cotton when applied/used as a plant-incorporated protectant. DowAgro Sciences, LLC submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act, as amended by the Food Quality Protection Act of 1996, requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus thuringiensis var. aizawai strain PS811 (Cry1F insecticidal protein) and the genetic material necessary for its production in cotton when used as a plant-incorporated protectant.

09/29/04 Tolerance Exemption Revoked - Because there are no active registrations and the tolerance exemption is no longer needed, EPA is revoking the tolerance exemption in 40 CFR 180.1115 for residues of Burkholderia cepacia type Wisconsin in or on all raw agricultural commodities when applied to plant roots and seedling roots, or as a seed treatment for growing agricultural crops.
09/29/04 Petition for Tolerance Establishment - EPA has received a pesticide petition (PP 2E6389) from AVA Chemical Ventures, LLC. of Portsmouth, NH proposing pursuant to section 408(d) of the Federal Food, Drug, and Cosmetic Act (FFDCA), 21 U.S.C. 346a(d), to amend 40 CFR part 180 by establishing tolerances for the residues of the insecticide sorbitol octanoate in or on all food agricultural commodities.

09/15/04 Petition for Tolerance Exemption - EPA has received a pesticide petition, 3G6547, from Syngenta Seeds of Research Triangle Park, NC proposing to amend 40 CFR part 180 by amending an existing exemption from the requirement of a tolerance, to include all VIP3A events. Bacillus thuringiensis VIP3A insect control protein is expressed as a plant-incorporated protectant in transgenic cotton plants to provide protection from key lepidopteran pests including, but not limited to, Helicoverpa zea (cotton bollworm), Heliothis virescens (tobacco budworm), and Pectinophora gossypiella (pink bollworm).
09/01/04 Experimental Use Permit Application - This notice announces receipt of an application 67979-EUP-U from Syngenta Seeds, Inc. - Field Crops - NAFTA requesting an experimental use permit (EUP) for modified Cry3A protein and the genetic material necessary for its production (via elements of pZM26) in Event MIR604 corn. 08/04/04 Conditional New Active Ingredient Approval - EPA issued a notice, published in the Federal Register of 10/09/02, which announced that Insect Biotechnology Inc. of Durham, NC had submitted an application to conditionally register the pesticide product, Technical Trypsin Modulating Oostatic Factor (TMOF), insecticide (EPA File Symbol 74411-R), containing Trypsin Modulating Oostatic Factor at 100%, an active ingredient not included in any previously registered product. The application was conditionally approved on May 24, 2004 as Technical Trypsin Modulating Oostatic Factor (TMOF) (EPA Registration Number 74411-1). The product is registered as a manufacturing use product for formulation into insecticides for control of mosquito larvae. As the only condition of registration, EPA is requiring the registrant to provide a storage stability study by May 24, 2006.
08/04/04 New Active Ingredient Approval - EPA issued a notice, published in the Federal Register of 10/04/00 , which announced that Natural Industries, Inc. of Houston, TX had submitted an application to register the pesticide product, Actinovate Soluble, Fungicide (EPA File Symbol 73314-R), containing Streptomyces lydicus WYEC 108 at 1.0% for control of root decay fungi. This product was not previously registered. The application was approved on May 24, 2004, as Actinovate Soluble (EPA Registration Number 73314-1) for control of root decay fungi.

07/28/04 Application for Experimental Use Permit - This notice announces receipt of an application 67979-EUP-L from Syngenta Seeds, Inc. - Field Crops - NAFTA requesting an experimental use permit (EUP) for the plant-incorporated protectant Bacillus thuringiensis VIP3A insect control protein as expressed in events COT202 and COT203 cotton plants. Syngenta Seeds is proposing to test 245 acres of the plant-incorporated protectant Bacillus thuringiensis VIP3A insect control protein as expressed in events COT202 and COT203 cotton plants from March 2005 to March 2006 in the States of Alabama, Arizona, Arkansas, California, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, and Texas.
07/14/04 Experimental Use Permits Granted - EPA has issued the following EUP: 69834-EUP-2. Issuance. EDEN Bioscience Corporation of Bothell, Washington. This EUP allows the use of 70.85 pounds of the biochemical pesticide Harpin [alpha][beta] protein on 4,942 acres of citrus, cotton, field corn, ornamentals, peanut, rice, soybean, sugarcane, and wheat to evaluate the control of post harvest diseases, enhancing overall plant health, thus improving stand establishment and enhancing crop yield and quality. The program is authorized only in the States of Alabama, Arizona, Arkansas, Colorado, Florida, Georgia, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Minnesota, Mississippi, Missouri, Nebraska, New Jersey, New York, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, South Carolina, South Dakota, Tennessee, Texas, Virginia, and Washington. The EUP is effective from April 26, 2004 to April 26, 2006. A tolerance has been established for residues of the active ingredient in or on all food commodities.
07/14/04 New Active Ingredient Approval - EPA issued a notice, published in the Federal Register of 8/06/2003 which announced that the Interregional Research Project No. 4 (IR-4), Rutgers University, Technology Center of New Jersey, North Brunswick, NJ on behalf of Morse Enterprises Limited, Inc. of Miami, FL 33129, had submitted applications to register a manufacturing use product, Yeast Hydrolysate Liquid (EPA File Symbol 73512-E) and the end use product, KeyPlex 350 (EPA File Symbol 73512-R) containing the new active ingredient Yeast Extract Hydrolysate from Saccharomyces cerevisiae, which was not included in any previously registered product. The following products were approved on February 19, 2004.
1. The manufacturing use product, Yeast Hydrolysate Liquid, containing 2.5% active ingredient (EPA Registration Number 73512-2) for use in the management of plant diseases.

5/12/04 FIFRA SAP Public Meeting - There will be a 3-day meeting of the Federal Insecticide, Fungicide, and Rodenticide Act Scientific Advisory Panel (FIFRA SAP) to consider and review product characterization, human health risk, ecological risk, and insect resistance management (IRM) for Bacillus thuringiensis (Bt) cotton products. Dow AgroSciences has submitted an application for full commercial use of their cotton plant-incorporated protectant (PIP), Cry1F/Cry1Ac known as WideStrike. This application was for a stacked PIP (one that contains two or more proteins). This stacked PIP contains at least one protein that has never been seen in cotton. The meeting will be held on June 8 to June 10, 2004.
5/5/04 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the biochemical harpin protein on all food commodities when applied/used to enhance plant growth, quality and yield, to improve overall plant health, and to aid in pest management. EDEN Bioscience Corporation submitted a petition to EPA requesting an exemption from the requirement of a tolerance. 4/28/04 New Active Ingredient Approval- EPA issued a notice, published in the FR on 5/07/2003 which announced that Jeneil Biosurfactant Company of Saukville, WI had submitted an application to register the pesticide product, ZONIXTM Biofungicide, a biochemical fungicide containing the new active ingredient, rhamnolipid biosurfactant. This product was not previously registered. The application was approved on March 23, 2004, as ZONIXTM Biofungicide (EPA Registration Number 72431-1) for the prevention and control of zoosporic pathogenic fungi in agricultural, horticultural and turf settings.
4/28/04 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the citronellol on all food commodity when applied/used to control Tetranychid mites. Natural Plant Protection S.A. submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of citronellol.
4/28/04 Request for Review of Field Test Received - This notice announces receipt of an Biotechnology Notification from West Virginia University requesting review of a small-scale field test for genetically modified Cryphonectria parasitica (Chestnut tree blight fungus). The proposed small-scale field release will be on part of three 0.1 acre plots of land in the Monongahela National Forest, near Circleville, West Virginia. The study will last for 3 years from 2004 through 2006.
4/28/04 Tolerance Exemption Established -  This regulation establishes an exemption from the requirement of a tolerance for residues of the geraniol on all food commodity when applied/used to control Tetranychid mites. 4/23/04 Revocation of Tolerance Exemptions for Certain Biopesticides - This document revokes exemptions from the requirement of a tolerance, as expressed in 40 CFR part 180, for residues of the following pesticide active ingredients because of non-payment of maintenance fees and because there are no active FIFRA product registrations applicable to these exemptions: Dihydroazadirachtin; Kontrol HV; Metarhizium anisopliae strain ESF1 in attractant stations; polyhedral occlusion bodies of Autographa californica NPV; Pseudomonas fluorescens EG-1053; Pseudomonas fluorescens NCIB 12089; and Puccinia canaliculata (ATCC 40199). In addition, this document revokes the tolerance exemption for Bacillus thuringiensis CryIA(b) delta-endotoxin and the genetic material necessary for its production in corn because that tolerance exemption has been replaced by a tolerance exemption that applies to all plants.

1/6/04 Experimental Use Permit Issued - EPA has issued the following EUPs: 68467-EUP-7 to Mycogen Seeds c/o Dow AgroSciences LLC of Indianapolis, IN and 29964-EUP-5 to Pioneer Hi-Bred International, of Johnston, IA. These EUP allows the use of the plant-incorporated protectant Bacillus thuringiensis Cry34/35Ab1 proteins and the genetic material necessary for their production (from the insert of plasmid PHP17662) in corn on 624 acres of field corn to conduct insect resistance management, maize agronomic observation, maize breeding and observation nursery, maize demonstration, maize efficacy, maize hybrid production plots, maize regulatory field studies, non-target organism, and herbicide tolerance trials. The program is authorized only in the States of California, Georgia, Hawaii, Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Nebraska, North Dakota, Ohio, Pennsylvania, South Dakota, Tennessee, Texas, Wisconsin, and the Commonwealth of Puerto Rico. These EUP is effective from June 24, 2003 to May 1, 2004. A tolerance has been established for residues of Bacillus thuringiensis Cry34Ab1 and Cry35Ab1 proteins and the genetic material necessary for their production in corn when used as plant-incorporated protectants in the food and feed commodities of field corn, sweet corn, and popcorn.
