12/06/06 Petition to Amend FIFRA Section 25(b); Comment Period Reopened - EPA issued a notice in the Federal Register of September 13, 2006, concerning a petition filed by the Consumer Specialty Products Association (CSPA) requesting the Agency to modify the minimum risk regulations at 40 CFR 152.25(f) for those products that claim to control public health pests to be subject to EPA registration requirements as a precondition of their sale. This document reopens the comment period for an additional 30 day period.
12/06/06 Rule on Food Packaging Treated with a Pesticide - This rule excepts from the definitions of “pesticide Chemical” and “pesticide chemical residue” under FFDCA section 201(q), food packaging (e.g. paper and paperboard, coatings, adhesives, and polymers) that is treated with a pesticide as defined in the FIFRA section 2(u). As a result, such ingredients in food packaging treated with a pesticide are exempt from regulation under FFDCA section 408 as pesticide chemical residues. Further, a food that bears or contains such ingredients are not subject to enforcement by the FDA under section 402(a)(2) (B) of the FFDCA since the ingredients are not pesticide chemical residues. Instead, such ingredients are subject to regulation by the FDA as food additives under FFDCA section 409.

11/01/06 Tolerance Exemption Established - This regulation establishes a permanent exemption from the requirement of a tolerance for residues of the Bacillus thuringiensis modified Cry3A protein (mCry3A) and the genetic material necessary for its production in corn on field corn, sweet corn, and popcorn when applied/used as a plant-incorporated protectant. Syngenta Seeds, Inc. submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus thuringiensis modified Cry3A protein (mCry3A) and the genetic material necessary for its production in corn.

9/27/06 Draft Guidance for Pesticide Registrants - EPA is announcing the availability of and seeking public comment on a draft Pesticide Registration Notice (PRN) entitled "Guidance on Small-Scale Field Testing and Low-level Intermittent Presence in Food of Plant-Incorporated Protectants (PIPs)." The draft PRN provides guidance to the registrant concerning clarification on the process by which EPA reviews and ensures the safety of low-level intermittently-present residues of plant-incorporated protectants (PIPs) in food or feed, and the conditions under which a tolerance or exemption from the requirement of a tolerance would be required for field tests for biotechnology-derived food and feed crop plants containing plant-incorporated protectants.
9/20/06 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of Pantoea Agglomerans strain E325 on apples and pears when applied/used as a microbial pesticide. Northwest Agricultural Products submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Pantoea agglomerans strain E325.
9/13/06 Petition to Amend Certain FIFRA Pesticide Products - This notice identifies a petition filed by the Consumer Specialty Products Association (CSPA) pertaining to FIFRA section 25(b) pesticide products. The petition requests the Agency to modify the minimum risk regulations at 40 CFR 152.25(f) for those products that claim to control public health pests (as defined in Pesticide Registration (PR) Notice 2002-1) and requests that any such product making public health claims be subject to EPA registration requirements as a precondition of their sale.
9/13/06 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of Eucalyptus Oil on honey and honeycomb when applied at 2 g or less eucalyptus oil per hive to suppress varroa mites. Brushy Mountain Bee farm, c/o IR-4 Project submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of eucalyptus oil in honey and honeycomb.
9/06/06 Request for Comments on Registration Application - This notice announces and requests comments on an application to register the pesticide product ShakeAway Deer Repellent Granules. Previously, EPA issued a notice, published in the Federal Register of December 15, 2004 (69 FR 75063) (FRL-7687-7), which announced that Shake-Away of Hamden, CT, had submitted an application to register the pesticide product, Deer Repellent Granules, an animal repellent (File Symbol 80917-R), containing 5% Coyote Urine. The application was approved on March 28, 2006, as Shake-Away Deer Repellent Granules (EPA Registration Number 80917-1) as an animal repellent.

2. File Symbol: 69295-E. Applicant: Milwaukee Metropolitan Sewerage District of Milwaukee, WI. Product name: Milorganite [reg] 6-2-0 Deer Repellent. Animal repellent Active ingredient: Activated Sewage Sludge at 87.57%. Proposal classification/Use: Animal repellent.
9/01/06 Time-limited Tolerance Established - This regulation establishes time-limited tolerances for residues of 2, 6-Diisopropylnaphthalene, resulting from post-harvest applications to potato, in or on fat (cattle, goat, hog, horse, and sheep) at 0.8 part per million (ppm); liver (cattle, goat, hog, horse, and sheep) at 0.3 ppm; meat (cattle, goat, hog, horse, and sheep) at 0.1 ppm; meat byproducts (cattle, goat, hog, horse, and sheep) at 0.1 ppm; milk at 0.1 ppm; potato at 2.0 ppm; and potato, wet peel at 6.0 ppm. Loveland Products, Inc. had requested permanent tolerances (in or on whole potato and potato peels at 2 and 6 ppm, respectively). The time-limited tolerances will expire on August 1, 2009.

8/30/06 Experimental Use Permits Granted - EPA has issued the following EUP:
82761-EUP-1. Issuance. Montana Microbial Products of Missoula, Montana. This EUP allows the use of 5.82 pounds of the fungicide Bacillus mycoides isolate J on 232.25 acres of sugar beets to evaluate the control of Cercospora Leaf Spot (Cercospora beticola). The program is authorized only in the States of Minnesota, Montana, and North Dakota. The EUP is effective from June 8, 2006 to December 31, 2007.
8/23/06 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of Phosphorous Acid and its ammonium, sodium, and potassium salts in or all food commodities to allow for post-harvest application to stored potatoes at 35,600 parts per million (ppm) or less of phosphorus acid. This exemption is being issued at EPA's own initiative. This regulation eliminates the need to establish a maximum permissible level for residues of phosphorous acid and its ammonium, sodium, and potassium salts.

8/16/06 Petition for Tolerance Exemption - EPA received a pesticide petition PP 6E7053. Morse Enterprises Limited, Inc. of Miami , Florida 33129 , proposes to establish an exemption from the requirement of a tolerance for residues of the biochemical bactericide and fungicide, Chitosan Hydrolysate, in or on all food commodities.
8/09/06 Tolerance Exemption Amended - This regulation amends the existing exemption from the requirement of a tolerance for residues of Lepidopteran Pheromones to include use as a ``post-harvest treatment'' on all stored food commodities. Bedoukian Research, Inc. submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of biochemicals classified as lepidopteran pheromones.

This EUP allows the use of 0.071 pounds (32 grams) of the insecticide Bacillus Thuringiensis Cry1Ab protein and the genetic material necessary for its production on 370 acres of Events T303-3 and T304-40 cotton plants to evaluate the control of cotton bollworm (Helicoverpa zea) and tobacco budworm (Heliothis virescens). The program is authorized only in the States of Louisiana, Mississippi, North Carolina, Puerto Rico, South Carolina, and Texas. The EUP is effective from February 7, 2006 to January 31, 2007.

6/28/06 Amendment to Tolerance Exemption Proposed - EPA proposes to amend the existing tolerance exemption for residues of Phosphorous Acid and its ammonium, sodium, and potassium salts in or on all food commodities to allow for post- harvest application to stored potatoes at 35,600 ppm or less phosphorous acid.
6/28/06 Comment Period on Reregistration Eligibility Decision Opened - EPA announces the availability of EPA's Reregistration Eligibility Decision (RED) for the pesticide Phytophthora Palmivora (MWV) and Methyl Salicylate, and opens a public comment period on this document. The Agency's risk assessments and other related documents also are available in the Phytophthora palmivora MWV and methyl salicylate Docket.

6/14/06 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of Potassium Silicate in or on all food commodities when applied/used as a fungicide, insecticide or miticide so long as the potassium silicate is not applied at rates exceeding 1% by weight in aqueous solution and when used in accordance with good agricultural practices. 4/26/06 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the Pantoea agglomerans strain C9-1 on pears and apples when applied or used as a microbial pesticide. Nufarm, Inc. submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Pantoea agglomerans strain C9-1.
4/26/06 Temporary Tolerance Exemption Established - This regulation establishes a temporary exemption from the requirement of a tolerance for residues of the Bacillus Thuringiensis VIP3A Insect Control Protein in cotton when applied or used as a plant incorporated protectant. Syngenta Seeds, Inc. submitted a petition to EPA requesting an extension to the existing temporary exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus Thuringiensis VIP3A Insect Control Protein. The temporary tolerance exemption will expire on May 1, 2007.
4/19/06 Petition for Tolerance Exemption - This notice announces the initial filing of a pesticide Petition PP 6F7035. Valent Biosciences Corporation of Libertyville, IL, proposes to establish an exemption from the requirement of a tolerance for residues of the biopesticide Q6-benzyladenine in or on pear.
4/14/06 Approval of New Active Ingredients

1. EPA issued a notice, published in the Federal Register of September 29, 2004 (69 FR 58164) (FRL-7679-2), which announced that AVA Chemical Ventures, L.L.C., of Portsmouth, NH, had submitted an application to register the pesticide product, Avachem Sorbitol Octanoate Manufacturing Use Product, an insecticide (EPA File Symbol 70950-U), containing Sorbitol octanoate; and another application to register the pesticide product, Avachem Sorbitol Octanoate 90.0%, insecticide (EPA File Symbol 70950-G), containing sorbitol octanoate. The products were not previously registered. Both applications were approved on January 17, 2006.

2. EPA issued another notice, published in the Federal Register of March 8, 2006, (71 FR 11621) (FRL-7765-2), which announced that Agricultural Research Initiatives, Inc., of Fayetteville, AR, had submitted an application to register the pesticide product, LockDown retro, a herbicide. (EPA File Symbol 82681-R), containing Colletotrichum gloeosporioides f.sp. aeschynomene and fermentation medium at 45%. This product was not previously registered. The application was approved on March 28, 2006, as LockDown retro (EPA Registration Number 82681-1) for herbicidal use.
4/14/06 Tolerance Exemption Amended - This regulation establishes an amendment to an exemption from the requirement of a tolerance for residues of Sodium metasilicate on all food commodities when applied/used as an insecticide or fungicide to control or suppress leafhoppers and powdery mildew in accordance with approved label rates and good agricultural practice. A petition was submitted to EPA on behalf of Environmentally Safe Systems, Inc. requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of sodium metasilicate.
4/12/06 Petition for Tolerance Amendment - This notice announces the initial filing of a Pesticide Petition (PP) 6F7044. This EUP allows the use of 414 pounds of the herbicide active ingredient Colletotrichum gloeosporioides f.sp. aeschynomene on 5,000 acres of rice to evaluate the control of northern joint vetch. 3/15/06 Extension of Temporary Tolerance Exemption - This regulation extends an existing temporary exemption from the requirement of a tolerance for residues of the Bacillus thuringiensis modified Cry3A protein (mCry3A) and the genetic material necessary for its production in corn on field corn, sweet corn, and popcorn when applied/used as a plant-incorporated protectant. Syngenta Seeds, Inc. submitted a petition requesting this extension. This regulation eliminates the need to establish a maximum permissible level for residues of modified Cry3A protein (mCry3A) and the genetic material necessary for its production in corn. The temporary tolerance exemption as extended will expire on October 15, 2007.

2/22/06 Conditional Approval of Active Ingredient - EPA issued a notice, published in the Federal Register of April 14, 2004 ( 69 FR 19845 ) (FRL-7352-7), which announced that AgraQuest, Inc. of Davis, CA, had submitted an application to conditionally register the pesticide product, Muscodor albus strain QST 20799, biofumigant (EPA File Symbol 69592-RU), containing Muscodor albus QST 20799, an active ingredient not included in any previously registered product. This application also included registration of three end-use products containing Muscodor albus QST 20799: Arabesque (EPA File Symbol 69592-RL); Andante (EPA File Symbol 69592-RT; and Glissade (EPA File Symbol 69592-RI).
