12/26/07 Tolerance Exemption Granted - Aspergillus flavus AF36, a biological fungicide - EPA is establishing a temporary exemption from the requirement of a tolerance for residues of this pesticide on corn when applied/used before corn tasseling occurs. The Arizona Cotton Research and Protection Council submitted a petition to EPA requesting the temporary tolerance exemption. This regulation eliminates the need to establish a maximum permissible level for residues of Aspergillus flavus AF36. The temporary tolerance exemption expires on December 31, 2011.
12/19/07 Experimental Use Permit Amended - EPA has announced the receipt of applications by Monsanto requesting amendment to the experimental use permit (EUP) for Bacillus thuringiensis Cry1A.105 protein and the genetic material necessary for its production (vector PV-ZMIR245) in event MON 89034 corn, Bacillus thuringiensis Cry2Ab2 protein and the genetic material necessary for its production (vector PV-ZMIR245) in event MON 89034 corn, and Bacillus thuringiensis Cry3Bb1 protein and the genetic material (vector PV-ZMIR39) necessary for its production in event MON 88017 corn. Monsanto proposes amending the EUP to allow the treatment of 11,952 acres in total. This includes a maximum of 4,421 acres for MON 89034 x MON 88017, 3,687 acres of MON 89034, 1,742 acres of MON 88017, 415 acres of corn containing registered plant-incorporated protectants (PIPS) and 1,687 acres of non-PIP and border rows. The proposed period of use of this amended EUP is February 15, 2008-June 15, 2009 .
12/12/07 Registration Review Docket Established - EPA has established a registration review docket for Nosema locustae, a microbe used to kill grasshoppers and Mormon crickets. Registration review is EPA's periodic review of pesticide registrations to ensure that each pesticide continues to satisfy the statutory standard for registration, that is, the pesticide can perform its intended function without unreasonable adverse effects on human health or the environment. Registration review dockets contain information that will assist the public in understanding the types of information and issues that the Agency may consider during the course of registration reviews. Through this program, EPA is ensuring that each pesticide's registration is based on current scientific and other knowledge, including its effects on human health and the environment.
12/6/07 Tolerance Exemption Extended - This regulation extends an exemption from the requirement of a tolerance for residues of the microbial active ingredient Bacillus thuringiensis Vip3Aa19 in cotton when applied/used as a plant-incorporated protectant. Syngenta Seeds Inc., submitted a petition to EPA requesting that the temporary tolerance exemption be extended. This regulation eliminates the need to establish a maximum permissible level for residues of the Bt.Vip3Aa19 protein in cotton when applied or used as a plant-incorporated protectant on field cotton. The temporary tolerance exemption expires on May 1, 2009.
12/5/07 Tolerance Exemption Extended - This regulation extends an exemption from the requirement of a tolerance for residues of the microbial active ingredient Bacillus thuringiensis Vip3Aa20 in corn when applied/used as a plant-incorporated protectant. Syngenta Seeds Inc., submitted a petition to EPA requesting that the temporary tolerance exemption be extended. This regulation eliminates the need to establish a maximum permissible level for residues of the Bt.Vip3Aa20 protein in corn when applied or used as a plant-incorporated protectant on field corn, sweet corn, and popcorn. The temporary tolerance exemption expires on 10/31/09.

11/02/07 Amendment for Existing Tolerance; New Exemptions from Tolerance - PP 7F7236. Growth Products Ltd., P.O. Box 1259, White Plains, NY 10602, proposes to amend the tolerance exemption in 40 CFR 180.1111 for residues of the fungicide Bacillus subtilis GB03 tolerance in or on all raw agricultural commodities when applied as a seed treatment for growing agricultural crops. PP 7F7254. Syngenta Seeds, Inc., P.O. Box 12257, 3054 E. Cornwallis Rd., Research Triangle Park, NC 27709, proposes to establish an exemption from the requirement of a tolerance for residues of the plant-incorporated protectant, Bacillus thuringiensis Vip3Aa proteins in all plants when used as plant-incorporated protectants in all crops and agricultural commodities. Syngenta's original petition requested an exemption for Bacillus thuringiensis Vip3Aa19 and Vip3Aa20 proteins in all plants; however, this original request was amended by Syngenta in a letter to the Agency dated September 6, 2007 to Bacillus thuringiensis Vip3Aa proteins in all plants. 10/24/07 Application for Registration. This notice announces receipt of an application 84185-G and 84185-U from Plasma Power of India and 93945-R from Coeur D'Alene Fiber fuels Inc., to register pesticide products containing neem Oil, an insecticide for agricultural food use at 100%.
10/17/07 Draft White Paper Regarding StarLink Corn Dietary Risk and Exposure - EPA is seeking public comment on a White Paper that recommends an end to routine testing for StarLink™ corn in the food supply. Testing of yellow corn started in 2000 following the detection of illegal residues of StarLink™ in the food supply. Since StarLink™ corn has not been planted since 2000, levels have steadily decreased to where new detections are virtually non-existent. After a thorough analysis, EPA has concluded that potential exposure of the U.S. population to the Cry9C protein in StarLink™ corn in the current U.S. food supply is extremely low, and continued testing of corn grain by grain handlers and millers for the presence of Cry9C provides no additional human health protection. EPA’s analysis supports the FDA proposal to withdraw its recommendation that dry milling facilities and masa operations test yellow corn shipments for the presence of StarLink-derived Cry9C.

9/19/07 Registration Review Docket Established - EPA has established a registration review docket for Pseudomonas syringae, a fungicide used on apples, pears, lemons, oranges, or grapefruit and is opening the public comment period for the registration review. Pseudomonas syringae is used for preventing various fungal diseases that occur after harvest on apples, pears, and certain citrus fruits. Based on extensive testing and the methods used in applying the bacteria to the fruit, these bacterial strains are not expected to harm either humans or the environment when used in pesticide products. Furthermore, these fungicides have the potential to decrease the use of other, more toxic fungicides that they may replace.
9/19/07 Registration Review Docket Established - EPA has established a registration review docket for Pseudomonas fluorescens, and is opening the public comment period. This naturally occurring bacteria prevents or reduces frost damage to plants by displacing bacteria that induce ice formation. Pseudomonas fluorescens, uses on certain fruit crops, almonds, potatoes, and tomatoes to prevent or reduce the growth of frost-forming bacteria on leaves and blossoms - Use of the bacteria as a pesticide active ingredient is not expected to cause adverse effects to humans or the environment. When used with other pesticide products, Pseudomonas fluorescens A506 can help suppress fire blight and discoloration on pear and apple crops, and bunch rot in grapes.
9/19/07 Registration Review Docket Established - EPA has established a registration review docket for Chitin, used for controlling soil nematodes on ornamentals, turf, and many food and non-food crops and is opening the public comment period. Chitin is used for controlling soil nematodes on ornamentals, turf, and many food and non-food crops at commercial and residential sites. The active ingredient is isolated from the shells of crustaceans, especially crabs and shrimp. Given its lack of toxicity, chitin is not expected to harm people, pets, wildlife, or the environment when used according to label directions.
9/12/07 Application for Experimental Use Permit - This notice announces receipt of an application 264-EUP-RUG from Bayer CropScience , requesting an experimental use permit (EUP) for the plant-incorporated protectant Cry2Ae in cotton on a total of 688 acres in the States of MS, NC, SC, TN and TX.

8/15/07 Pesticide Products; Conditional Registration Approval - Genetically Engineered Corn Varieties of Syngenta Seeds, Monsanto Company, Pioneer Hi-Bred International (A Dupont Company), and Mycogen Seeds (c/o Dow AgroSciences) - EPA has conditionally approved pesticide registration applications submitted by the companies for the pesticide products Agrisure\TM\ RW Rootworm-Protected Corn, MON 88017, MON 88017 x MON 810, Herculex Rootworm Insect Protection, and Herculex RW Insect Protection. A conditional registration may be granted under section 3(c)(7)(C) of FIFRA for a new active ingredient where certain data are lacking, on condition that such data are received by the end of the conditional registration period and do not meet or exceed the risk criteria set forth in 40 CFR 154.7; that use of the pesticide during the conditional registration period will not cause unreasonable adverse effects; and that use of the pesticide is in the public interest. The Agency has considered the available data on the risks associated with the proposed use of Modified Cry3A protein and the genetic material necessary for its production (via elements of pZM26) in event MIR604 corn SYN-IR604-8, Bacillus thuringiensis Cry3Bb1 protein and the genetic material necessary for its production (Vector ZMIR39) in Event MON 88017 corn (OECD Unique Identifier: MON-88O17-3), and Bacillus thuringiensis Cry34Ab1 and Cry35Ab1 proteins and the genetic material necessary for their production (plasmid insert PHP 17662) in Event DAS-59122-7 corn, and information on social, economic, and environmental benefits to be derived from such use.

Interrregional Research project Number 4 (IR-4) on behalf of the Arizona Cotton Research and Protection Council submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting the temporary tolerance exemption. This regulation eliminates the need to establish a maximum permissible level for residues of Aspergillus flavus AF36 . The temporary tolerance exemption expires on May 14, 2010.
5/16/07 Aspergillus flavus NRRL 21882 in Corn; Temporary Exemption From the Requirement of a Tolerance - This regulation establishes a temporary exemption from the requirement of a tolerance for residues of the Aspergillus flavus NRRL 21882 in corn when applied aerially at the first sign of tasseling. Acta Group submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting the temporary tolerance exemption. This regulation eliminates the need to establish a maximum permissible level for residues of Aspergillus flavus NRRL 21882. The temporary tolerance exemption expires on May 2, 2009.
5/16/07 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the microbial active ingredient Pythium oligandrum DV 74 on food crops. Biopreparaty Co. Ltd. submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Pythium oligandrum DV 74.
5/16/07 Experimental Use Permit Granted - EPA has issued an EUP to Circle One Global, Inc. of Shellman, GA which allows the use of less than 75,000 pounds of the antifungal agent containing less than 7.5 pounds of the active ingredient, Aspergillus flavus NRRL 21882 on 6,000 acres of corn in the State of Texas. This EUP expires on 5/2/09.
5/09/07 Tolerance Exemption Granted - Residues of Bacillus thuringiensis Vip3Aa19 protein in cotton are temporarily exempt from the requirement of a tolerance when used as a plant-incorporated protectant (PIP) in the food and feed commodities of cotton; vegetative-insecticidal protein in cotton seed, cotton oil, cotton meal, cotton hay, cotton hulls, cotton forage, and cotton gin byproducts. This temporary exemption from the requirement of tolerance will permit the use of the food commodities in this section when treated in accordance with the provisions of the experimental use permit (EUP) 67979-EUP-7, which is being issued in accordance with the provisions of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended (7 U.S.C. 136). This temporary exemption from the requirement of a tolerance expires and is revoked May 1, 2008.

3/21/07 Guidance for Pesticide Registrants on Disposal Instructions - The Agency is announcing the availability of a Pesticide Registration Notice entitled "Disposal Instructions on Non-Antimicrobial Residential/Household Use Pesticide Product Labels.'' This Notice provides guidance to the registrant concerning the updating and revision of PR Notice 2001-6 to clarify that the use of a toll free number in the disposal instructions on non- antimicrobial residential/household use pesticide product labels is optional. If registrants choose to change or remove a toll free number from the disposal instructions on their label, this notice provides guidance on making such changes.
3/14/07 Conditional Approval of Active Ingredient - EPA issued a notice, published in the Federal Register of February 15, 2006 (71 FR 7954) (FRL-7761-5), which announced that Jabb of the Carolinas of Pine Level, NC, had submitted an application to conditionally register the pesticide products, Beauveria bassiana HF23 Technical, containing an active ingredient not included in any previously registered product. Listed below are the applications conditionally approved on December 27, 2006:
1. EPA File Symbol 70787-1: Beauveria bassiana HF23 Technical at 95 percent for use as a Manufacturing product for insecticides.
2. EPA File Symbol 70787-2: End-use Product (EP) balEnce containing 1.18 percent of Beauveria bassiana HF23 Technical for treatment of poultry houses to control house fly in chicken manure.
3/09/07 Application for Experimental Use Permit - This notice announces receipt of an application 75624-EUP-E from The Acta Group, on behalf of Circle One Global, Inc., requesting an experimental use permit (EUP) for Aspergillus flavus NRRL 21882.
3/09/07 Application for Experimental Use Permit - This notice announces receipt of an application 71693-EUP-R from Interregional Research Project Number 4 (IR-4), on behalf of the Arizona Cotton Research and Protection Council, requesting an experimental use permit (EUP) for Aspergillus flavus AF36.
3/07/07 Application for New Active Ingredient - EPA received the following application to register pesticide product containing an active ingredient not included in any previously registered products: File Symbol: 82608-R. Applicant: AgroGreen, Biological Division, Minrav Infrastructures of Israel, submitted by RegWest Company, LLC, of Greeley, CO. Product name: Chancellor. Nematode suppressant and plant growth regulator. Active ingredient: Bacillus firmus strain I-1582 at 0.66%. Proposal classification/Use: Microbial pesticide/nematode suppressant and plant growth regulator.

2/28/07 Approval of and Requests for Comments on new Active Ingredient - This notice announces and requests comments on an application to register the pesticide product Isomate-CM/LR TT. Comments must be received on or before March 30, 2007. On January 19, 2007, EPA approved an application to register the pesticide product containing three new active ingredients: Z-9-tetradecen-1-yl acetate, Z-11-tetradecen-1-ol, and Z- 11-tetradecenal (EPA File Symbol 53575-31).
2/02/07 Withdrawal of Direct Final Rule - Because EPA has received adverse comments, the Agency is withdrawing the direct final rule excepting from the definitions of ``pesticide chemical'' and ``pesticide chemical residue'' food packaging (e.g., paper and paperboard, coatings, adhesives, and polymers) that is treated with a pesticide. The direct final rule published at 71 FR 70667 , December 6, 2006, is withdrawn, effective January 25, 2007.

1/24/07 Experimental Use Permits Granted - EPA has issued the following EUPs (allowing specified acreages and trial protocols, authorized for certain states):

73049-EUP-3. Issuance. Valent BioSciences Corp. of Libertyville, IL. This EUP allows the use of 15,873 lbs of the plant regulator S-Abscisic acid over a 3 year period on 240 acres of ornamental plants in the states of AZ, CA, CO, FL, GA, IL, MI, NJ, NY, NC, OH, OR, PA, SC, TX, WA, and WI. The EUP is effective from February 28, 2007 to March 1, 2010.

524-EUP-97. Issuance. Monsanto Co. of St. Louis, MO. This EUP allows the use of 165,700 lbs of corn seed containing the following plant-incorporated protectants (PIPs) in the amounts specified: 0.47 lbs of the Bacillus thuringiensis Cry1A.105 protein and the genetic material necessary for its production (vector PV-ZMIR245) in Event MON 89034 corn, 0.41 lbs of the Bacillus thuringiensis Cry2Ab2 protein and the genetic material necessary for its production (vector PV-ZMIR245) in Event MON 89034 corn, and 1.49 lbs of the Bacillus thuringiensis Cry3Bb1 protein and the genetic material necessary for its production (vector ZMIR39) in Event MON 88017 corn. The EUP is effective from June 29, 2005 to June 30, 2008.

67979-EUP-4. Amendment/Extension. Syngenta Seeds, Inc. of Research Triangle Park, NC. This EUP allows the use of 50,420 lbs MIR604 and Bt11 corn seed containing the following PIPs in the amounts specified: A combined 0.0454 lbs of modified Cry3A Bacillus thuringiensis protein and the genetic material necessary for its production (via elements of pZM26) in Event MIR604 corn (SYN-IR6[Oslash]4-5) and Bt11 Bacillus thuringiensis Cry1Ab delta-endotoxin and the genetic material necessary for its production (plasmid vector pZ01502) in corn. The EUP is effective from March 2, 2006 to February 28, 2007.
1/17/07 Application for Experimental Use Permit - This notice announces receipt of an application 264-EUP-140 from Bayer CropScience LP requesting an experimental use permit (EUP) for the Bacillus thuringiensis Cry1Ab protein and the genetic material necessary for its production in Events T303-3 and T304-40 cotton plants.
1/12/07 Petition for Extension of Tolerance Exemption - This notice announces the initial filing of a pesticide petition PP 3G6547. Syngenta Seeds, Inc. of Research Triangle Park, NC, proposes a time-extension for 3 years until May 1, 2010, for the current exemption from the requirement of a tolerance for residues of the biopesticide, Bacillus thuringiensis VIP3A913 protein and the genetic material necessary for its production, in or on the commodity cotton.
1/10/07 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the microbial active ingredient Beauveria bassiana HF23 (B. bassiana HF23) on all food and feed commodities when applied/used to treat chicken manure which will eventually be processed and used as fertilizer on agricultural crops. Jabb of the Carolinas submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of B. bassiana HF23.
