12/28/05 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the bacteriophages that specifically target the bacterial pathogens Xanthomonas campestris pv. Vesicatoria and Pseudomonas syringae pv. tomato present on tomatoes and peppers when applied/used as bacteriocides on tomatoes and peppers. Omnylytics submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Xanthomonas campestris pv. vesicatoria and Pseudomonas syringae pv. tomato specific bacteriophages when applied/ used as bacteriocides on tomatoes and peppers.
12/28/05 New Active Ingredient Approval

1. EPA issued a notice, published in the Federal Register of August 10, 2005 (70 FR 46507) (FRL-7724-3), which announced that ARCADIS Innovative Tree Services of Millersville, MD, had submitted an application to register the pesticide product, Dutch Trig[reg], a fungicide (File Symbol 71927-R), containing the active ingredient, Verticillium isolate WCS 850. This product is intended to protect elm trees from Dutch elm disease. The application was approved on October 19, 2005, as Dutch Trig[reg] (EPA Registration Number 71927-1).

2. EPA issued a notice, published in the Federal Register of December 15, 2004 (69 FR 75063-75065) (FRL-7687-7), which announced that Heads Up Plant Protectants Inc. of Great Falls, VA, had submitted an application to register the pesticide product, Heads Up Plant Protectant, a fungicide. (EPA File Symbol 81853-R), containing Saponins of Chenopodium quinoa, with saponins at 49.65%. This product was not previously registered. The application was approved on September 16, 2005, as Heads Up Plant Protectant, (EPA Registration Number 81853-1).
12/15/05 Application for New Active Ingredient - EPA received an application as follows to register a pesticide product containing an active ingredient not included in any previously registered products: File Symbol: 56336-UT. Applicant: Suterra LLC of Bend, Oregon. Product Name: Checkmate BAW Technical Pheromone. [Biochemical for mating disruption of Beet Armyworm Moth (Spodoptera exigua)]. Active ingredient: (Z,E)-9,12-Tetradecadien-1-yl Acetate at 87.66%. Proposed classification/Use: Biochemical for the mating disruption of Beet Armyworm Moth (Spodoptera exigua) for manufacturing use only.
12/09/05 Petition for Tolerance Amendment - EPA received pesticide petition PP 1F6338. Loveland Products, Inc. of Greeley, CO, proposes to amend the tolerances in 40 CFR 180.590 for residues of the biochemical pesticide 2,6-diisopropylnaphthalene (2,6-DIPN) in or on the food commodities whole potatoes at 2 parts per million (ppm) and potato peels at 6 ppm.
12/07/05 Petition for Tolerance Establishment - EPA received a pesticide petition PP 6F4609. Syngenta Crop Protection, Inc. of Greensboro, NC, proposes to establish a tolerance for residues of the herbicide diquat dibromide in or on in or on food commodities pea and bean, dried shelled (except soybean) (subgroup6-C) at 0.80 parts per million.
12/07/05 Petition for Tolerance Exemption - EPA received a pesticide petition PP 5F6985. Hercon Environmental of Emigsville, PA, proposes to establish an exemption from the requirement of a tolerance for residues of the biochemical pesticide (Z)-7,8-epoxy-2-methyloctadecane in or on all food and feed commodities.
12/07/05 Petition for Tolerance Exemption - EPA received a pesticide petition PP 5F6960. Jabb of the Carolinas of Pine Level, NC, proposes to establish an exemption from the requirement of a tolerance for residues of the microbial pesticide Beauveria bassiana HF 23 in or on all food and feed commodities.

10/28/05 New Active Ingredient Approval - EPA issued a notice, published in the Federal Register of September 24, 2004 (69 FR 57284) (FRL-7674-5), which announced that Farma Tech International Corporation of Fresno, CA had submitted an application to register the pesticide product, Cuelure (File Symbol 81325-R), a semiochemical attractant for manufacturing end-use products, containing the active ingredient 4-(p-acetoxyphenyl)-2-Butanone at 98.00%, an active ingredient not included in any previously registered product. The application was approved on September 29, 2005 as Cuelure for manufacturing end-use products to control certain Tephriditae flies of the order Diptera (EPA Registration Number 81325-1).
10/19/05 Conditional Approval of Active Ingredient

EPA issued a notice, published in the Federal Register of March 13, 2002 ( 67 FR 11333 ) (FRL-6827-3), which announced that Monsanto Company of St. Louis, MO, had submitted an application to conditionally register the pesticide product, Event MON 863: Corn Rootworm Protected Corn (ZMIR13L), a plant-incorporated protectant (EPA File Symbol 524-LEI), containing Bacillus thuringiensis Cry3Bb1 protein and the genetic material necessary for its production (Vector ZMIR13L) in corn, an active ingredient not included in any previously registered product. The application was conditionally approved on February 24, 2003 for the product: Event MON 863, Corn Rootworm Protected Corn (ZMIR13L) (EPA Reg. No. 524-528) for use as a plant-incorporated protectant in corn.

EPA issued a notice, published in the Federal Register of April 2, 2003 ( 68 FR 16036 ) (FRL-7286-1), which announced that Monsanto Company had submitted an application to conditionally register the pesticide product, YieldGard Plus Corn, a plant-incorporated protectant (EPA File Symbol 524-LUL), containing Bacillus thuringiensis Cry3Bb1 protein and the genetic material necessary for its production (Vector ZMIR13L) in corn and Bacillus thuringiensis Cry1A(b) delta endotoxin and the genetic material necessary for its production in corn via conventional breeding. The application was conditionally approved on October 25, 2003 for the product: YieldGard Plus Corn (EPA Registration Number 524-545) for use as a plant-incorporated protectant in corn.

9/28/05 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the Muscodor albus (M. albus) QST 20799 and the volatiles produced on its rehydration on all food commodities when applied or used for all agricultural applications, including seed, propagule and post harvest treatments. This action is in response to a pesticide petition submitted to EPA by AgraQuest, Inc., requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of M. albus QST 20799 and the volatiles produced on its rehydration.
9/21/05 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the biochemical pesticide Reynoutria sachalinensis extract on all food commodities. The Interregional Research Project Number 4 (IR-4), on behalf of KHH Bioscience, Inc., submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Reynoutria sachalinensis extract.
9/21/05 Tolerance Exemption Amendment - This document proposes to amend an exemption from the requirement of a tolerance for residues of the C8, C10, and C12 straight-chain fatty acid monoesters of glycerol and propylene glycol on all food commodities when applied/used for both pre-harvest and post-harvest purposes. On June 23, 2004, EPA established an exemption from the requirement of a tolerance for these residues but did not expressly approve post-harvest uses. EPA is proposing this regulation, to amend the existing tolerance exemption to allow for post-harvest uses of C8, C10, and C12 straight-chain fatty acid monoesters of glycerol and propylene glycol.
9/21/05 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the Bacillus thuringiensis Cry34Ab1 and Cry35Ab1 proteins and the genetic material necessary for their production in corn on corn, field; corn, sweet; and corn, pop when applied/used as a plant-incorporated protectant. Mycogen Seeds c/o Dow AgroSciences LLC submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus thuringiensis Cry34Ab1 and Cry35Ab1 proteins and the genetic material necessary for their production in corn.

1. EPA issued a notice, published in the Federal Register of September 1, 2004 ( 69 FR 53432 ) (FRL-7370-3), which announced that Mycogen Seeds, c/o Dow AgroSciences LLC, of Indianapolis, IN had submitted an application to register the pesticide product, Mycogen Brand B.t. moCry1F Insect Resistant Corn Seed (EPA File Symbol 68467-U), a plant-incorporated protectant, containing Bacillus thuringiensis var. aizawai strain PS811 Cry1F insecticidal crystal protein and the genetic material necessary for its production (plasmid insert PHP12537) in Event DAS-06275-8. This product was not previously registered.

2. EPA issued a notice, published in the Federal Register of September 19, 2001 ( 66 FR 48256 ) (FRL-6794-5), which announced that Valent Biosciences Corporation of Libertyville, IL had submitted an application to register the pesticide product, Florbac Slurry, a microbial insecticide (EPA File Symbol 73049-AI), containing Bacillus thuringiensis var. aizawai strain NB 200. This product was not previously registered. This application was approved on June 10, 2005, as Florbac Slurry (EPA Registration Number 73049-68) for manufacturing use.

Applicant: Arcadis Geraghty and Miller of Tampa, FL. Product Name: DutchTrig. Microbial pesticide. Active ingredient: Verticillium dahliae isolate WCS 850. Proposed classification/Use: Non-food use only involving the American elm.
8/10/05 Application for Experimental Use Permit - This notice announces receipt of an application 264-EUP-RUN from Bayer CropScience LP requesting an experimental use permit (EUP) for the plant incorporated-protectant Bacillus thuringiensis subsp. berliner Cry1Ab insecticidal protein and the genetic material necessary for its production in cotton plants.
8/10/05 Experimental Use Permits Granted - EPA has issued the following EUPs, (each of these being granted for specific uses and selected states):
524-EUP-96. Amendment/Extension. Monsanto Company of St. Louis, MO. This EUP allows the use of 3.63 pounds of the insecticides Bacillus thuringiensis Cry3Bb1 protein and the genetic material necessary for its production (vector ZMIR39) in corn and Bacillus thuringiensis Cry1Ab delta-endotoxin and the genetic material necessary for its production (vector PV-ZMCT01) in corn on 4,683 acres of corn. The EUP is effective from February 18, 2005 to March 1, 2006.
68467-EUP-7. Amendment/Extension. Mycogen Seeds, c/o Dow AgroSciences LLC, of Indianapolis, IN. This EUP allows the use of 2,734.85 grams Cry34Ab1 and 10.88 grams Cry35Ab1 of the insecticides Cry34/35Ab1 proteins and the genetic material necessary for their production (from the insert of plasmid PHP17662) in corn on 3,096 acres of corn. The EUP is effective from January 21, 2005 to April 30, 2006.
29964-EUP-5. Amendment/Extension. Pioneer Hi-Bred International, Inc. of Johnston, IA. This EUP allows the use of 1,813.6 grams Cry34Ab1 and 47.2 grams Cry35Ab1 of the insecticides Cry34/35Ab1 proteins and the genetic material necessary for their production (from the insert of plasmid PHP17662) in corn on 5,115 acres of corn. The EUP is effective from January 25, 2005 to April 30, 2006.
67979-EUP-3. Issuance. Syngenta Seeds, Inc. of Research Triangle Park, NC. This EUP allows the use of 2.91 grams of the Cry1Ab Bacillus thuringiensis Cry1Ab protein and the genetic material necessary for its production (via elements of p2062) in corn on 294 acres of corn to evaluate the control of various lepidopteran insect pests. The EUP is effective from May 6, 2004 to August 15, 2005.
67979-EUP-4. Issuance. Syngenta Seeds, Inc. of Research Triangle Park, NC. This EUP allows the use of 15.53 grams of the insecticide Modified Cry3A Bacillus thuringiensis protein and the genetic material necessary for its production (via elements of pZM26) in Event MIR604 corn (SYN-IR6[oslash]4-5) on 575 acres of corn. The EUP is effective from March 23, 2005 to October 15, 2006.
8/03/05 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of acetic acid when used as a preservative for post-harvest stored grains and hay intended for animal feed. Eastman Chemical Company submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of acetic acid for this use.

6/22/05 New Active Ingredient Approval

1. EPA issued a notice, published in the Federal Register of January 28, 2004 (69 FR 4133-4135) (FRL-7339-9), which announced that Bedoukian Research, Inc. of Danbury, CT had submitted an application to register the pesticide product, Bedoukian (Z)-6-Heneicosen-11-one Technical Pheromone, Pheromone/attractant (EPA File Symbol 52991-RT), containing (Z)-6-Heneicosen-11-one. This product was not previously registered. The application was approved on January 21, 2005, as Bedoukian (Z)-6-Heneicosen-11-one Technical Pheromone (EPA Registration Number 52991-17) for incorporation into end-use products, and not for direct treatment of pest.

2. EPA issued a notice, published in the Federal Register of August 11, 2004 (69 FR 48867-48870) (FRL-7365-9), which announced that Eden Bioscience Corporation of Bothell, WA had submitted an application to register the pesticide product, EBC-351, a biochemical pesticide that provides growth enhancement, disease suppression and enhances crop yield (EPA File Symbol 69834-L), containing Harpin[alpha][beta] Protein. This product was not previously registered. The application was approved on February 9, 2005, as ProAct (formerly EBC-351) (EPA Registration Number 69834-5) for use on all food commodities as well as on turf, trees, and ornamentals.

3. EPA issued a notice, published in the Federal Register of February 7, 2001 (66 FR 9318-9319) (FRL-6754-9), which announced that Platte Chemical Company (Note: The present manufacturer is Loveland Products, Inc. of Greely, CO) had submitted an application to register the pesticide products, Smolder WP, herbicide (EPA File Symbol 34704-IEL) and, Smolder G, herbicide (EPA File Symbol 34704-IEU), containing Alternaria destruens strain 059. 6/08/05 Petition for Tolerance Exemption - EPA has received a pesticide petition (PP 5F6899) from Woodstream Corporation of Lititz, PA, proposing to amend 40 CFR part 180 to establish an exemption from the requirement of a tolerance for the biochemical pesticide ferric sodium EDTA.

1. EPA issued a notice, published in the Federal Register of November 14, 2003 (68 FR 64623) (FRL-7331-8), which announced that Prophyta Biologischer Pflanzenschutz GmbH, Germany, c/o WF Stoneman Company, LLC, McFarland, WI, had submitted an application to register the pesticide product, MeloCon WG, a nematicide specific for plant root nematodes (72444-E), containing the fungus Paecilomyces lilacinus strain 251 at 6.0%, an active ingredient not included in any previously registered product. 5/18/05 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the microbial pesticide Alternaria destruens Strain 059 (also referred to in this document as A. destruens) on all agricultural commodities when applied/used in accordance with label directions. Loveland Products Inc. submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of A. destruens.

4/28/05 Extension of Temporary Tolerance Exemption - This regulation establishes an extension of the temporary exemption from the requirement of a tolerance for residues of Bacillus thuringiensis VIP3A protein and the genetic material necessary for its production on cotton when applied/used as a plant-incorporated protectant. Syngenta Seeds submitted a petition requesting this extension. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus thuringiensis VIP3A protein and the genetic material necessary for its production on cotton. The temporary tolerance exemption will expire on May 1, 2006.
4/27/05 Petition for Tolerance Exemption - EPA has received a pesticide petition 3F6752 from Vita (Europe) Limited, c/o Landis International, Valdosta, GA, proposing pursuant to amend 40 CFR part 180 to establish an exemption from the requirement of a tolerance for the biochemical pesticide thymol.
4/13/05 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the fungus Paecilomyces lilacinus (P. lilacinus) strain 251 in or on food commodities when applied or used in accordance with label directions. Prophyta Biologischer Pflanzenschutz GmbH, Germany submitted a petition to EPA requesting an exemption from the requirement of a tolerance. Notification that EPA had received the petition was published on November 7, 2003. This regulation eliminates the need to establish a maximum permissible level for residues of P. lilacinus strain 251.
4/06/05 Temporary Tolerance Exemption Established - This regulation establishes a temporary exemption from the requirement of a tolerance for residues of the Bacillus thuringiensis modified Cry3A protein (mCry3A) and the genetic material necessary for its production in corn on field corn, sweet corn, and popcorn when applied/used as a plant-incorporated protectant. Syngenta Seeds, Inc. submitted a petition to EPA requesting the temporary tolerance exemption. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus thuringiensis modified Cry3A protein (mCry3A) and the genetic material necessary for its production in corn. The temporary tolerance exemption will expire on October 15, 2006.

3/30/05 Experimental Use Permit Granted - EPA has issued the following EUP: 70341-EUP-4. Issuance. IPM Tech, Inc., 4134 North Vancouver Ave., Suite 105, Portland, OR 97217. This EUP allows the use of 104.79 pounds of the attracticide containing 6.29 pounds of permethrin, 0.1592 pounds of the pheromone (E)-9-dodecen-1-yl acetate, and 0.0084 pounds of the pheromone (E)-9,11-dodecadien-1-yl acetate on 250 acres of loblolly and shortleaf pine to evaluate the control of Nantucket pine tip moths. The program is authorized only in the States of Georgia and Virginia. The EUP is effective from March 2, 2005, to March 5, 2006.
3/16/05 Petition for Tolerance Exemption; Correction - The purpose of this document is to clarify that pesticide petition 3G6547 from Syngenta Seeds, as summarized and presented in the Agency's September 15, 2004, Notice of Filing, is solely a proposal to amend the temporary tolerance exemption found at 40 CFR 180.1247 by extending it from May 1, 2005 to May 1, 2006. To the extent there is any language in that Notice of Filing discussing or alluding to Syngenta Seeds' request to make that temporary tolerance exemption non-event specific, that language is to be disregarded.
3/16/05 Experimental Use Permits Granted - EPA has issued the EUP, 67979-EUP-5, to Syngenta Seeds of Research Triangle Park, NC. This EUP allows the use of 0.14 pounds of the insecticide Vip3A insect control protein as expressed in Events COT 202 and COT 203-derived cotton plants on 467 acres of cotton to evaluate the control of various lepidopteran insect pests. The program is authorized only in the States of Alabama, Arizona, Arkansas, California, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, and Texas. The EUP is effective from February 1, 2005 to March 31, 2006.
