| 12/28/05 | Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the bacteriophages that specifically target the bacterial pathogens Xanthomonas campestris pv. Vesicatoria and Pseudomonas syringae pv. tomato present on tomatoes and peppers when applied/used as bacteriocides on tomatoes and peppers. Omnylytics submitted a petition to EPA requesting an exemption from the requirement of a tolerance. EPA issued a notice, published in the Federal Register of August 10, 2005 (70 FR 46507) (FRL-7724-3), which announced that ARCADIS Innovative Tree Services of Millersville, MD, had submitted an application to register the pesticide product, Dutch Trig[reg], a fungicide (File Symbol 71927-R), containing the active ingredient, Verticillium isolate WCS 850. This product is intended to protect elm trees from Dutch elm disease. The application was approved on October 19, 2005, as Dutch Trig[reg] (EPA Registration Number 71927-1). 2. EPA issued a notice, published in the Federal Register of December 15, 2004 (69 FR 75063-75065) (FRL-7687-7), which announced that Heads Up Plant Protectants Inc. of Great Falls, VA, had submitted an application to register the pesticide product, Heads Up Plant Protectant, a fungicide. This action is in response to a pesticide petition submitted to EPA by AgraQuest, Inc., requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of M. albus QST 20799 and the volatiles produced on its rehydration. |
| 9/21/05 | Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the biochemical pesticide Reynoutria sachalinensis extract on all food commodities. The Interregional Research Project Number 4 (IR-4), on behalf of KHH Bioscience, Inc., submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Reynoutria sachalinensis extract. |
| 9/21/05 | Tolerance Exemption Amendment - This document proposes to amend an exemption from the requirement of a tolerance for residues of the C8, C10, and C12 straight-chain fatty acid monoesters of glycerol and propylene glycol on all food commodities when applied/used for both pre-harvest and post-harvest purposes. On June 23, 2004, EPA established an exemption from the requirement of a tolerance for these residues but did not expressly approve post-harvest uses. EPA is proposing this regulation, to amend the existing tolerance exemption to allow for post-harvest uses of C8, C10, and C12 straight-chain fatty acid monoesters of glycerol and propylene glycol. |

To the extent there is any language in that Notice of Filing discussing or alluding to Syngenta Seeds' request to make that temporary tolerance exemption non-event specific, that language is to be disregarded. |
