11/18/09 Temporary Tolerance Exemption Granted: This regulation establishes time-limited tolerances for residues of 2,6-diisopropylnaphthalene (2,6-DIPN), including its metabolites and degradates, resulting from post-harvest applications to potatoes, in or on various commodities. Loveland Products, Incorporated requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA). The tolerances will expire on May 18, 2012.
11/2/09 Reopening of Comment Period: This document reopens the public comment period established in the Federal Register of October 21, 2009 (74 FR 54043) (FRL-8795-7). EPA is hereby reopening the comment period, which was originally scheduled to end on November 2, 2009, to November 16, 2009.

10/28/09 Tolerance Exemption Granted: This regulation establishes an exemption from the requirement of a tolerance for residues of the microbial fungicide, Ulocladium oudemansii (U3 Strain), in or on all food commodities when applied or used pre-harvest only, and excluding applications made post-harvest or to processed commodities.
10/28/09 Tolerance Exemption Granted: Residues of the biochemical pesticide cold pressed neem oil are exempt from the requirement of a tolerance in or on all food commodities.
10/07/09 Experimental Use Permits Amended: EPA has amended the following EUPs: 71693-EUP-1. Amendment. Mr. Larry C. Antilla. Arizona Cotton Research and Protection Council, 3721 Wier Avenue, Phoenix, AZ 85040. This EUP is amended to allow the use of 40,000 pounds of the end-use product per year (equivalent to 0.32 pound active ingredient per year) of the anti fungal agent Aspergillus flavus AF36 on 4,000 acres of pistachio to evaluate the control reduction of aflatoxin. The program is authorized only in the States of Arizona and California. The EUP is amended to expire on December 31, 2011.

9/30/09 Experimental Use Permit Requested: This notice announces EPA's receipt of an application 67979- EUP-I from Syngenta Seeds Inc. requesting an experimental use permit (EUP) for the plant-incorporated protectant (PIP) [Event 5307] Bacillus thuringiensis eCry3.1Ab protein and the genetic material necessary for its production (vector pSYN12274) in event 5307 corn (SYN- [Oslash]53[Oslash]7-1) and combined trait hybrids with one or more of the following additional PIPs:

9/30/09 Temporary Tolerance Exemption Requested: EPA is seeking comments on a request from Syngenta Seeds Inc. to establish a temporary exemption from the requirement of a tolerance for residues of the Bacillus thuringiensis eCry3.1Ab protein, when used as a plant-incorporated protectant, in or on the food and feed commodities of corn; corn, field; corn, sweet; and corn, pop.
9/30/09 Final Registration Review: EPA has announced the availability of its final registration review decision for the pesticide Pseudomonas fluorescens strain A506 (PC Code 006438) a microbial pesticide that is used to prevent or reduce the growth of frost-forming bacteria on leaves and blossoms of almonds, apples, peaches, pears, tomatoes, cherries, grapes potatoes and strawberries. When Pseudomonas fluorescens is used with antibiotic pesticide products in accordance with labeling instructions, it can help improve control of fire blight and discoloration on pear and apple crops; and bunch rot in grapes caused by Acetobacter bacteria when used in combination with Aspergillus niger and Botrytis cinerea.
9/30/09 Registration Review Final Decision: this notice announces the availability of EPA's final registration review decision for Pseudomonas syringae, case 6007 composed of the following Active Ingredients: Pseudomonas syringae strains ESC-10 and ESC-11 (PC Codes 006441 and 006451) used to control various molds and rots on harvested apples, cherries, pears, lemons, oranges, grapefruit, potatoes, and sweet potatoes. Pseudomonas syringae strain 742RS (PC Code 006411) used to prevent or reduce the growth of frost-forming bacteria on leaves and blossoms of almonds, apples, peaches, pears, tomatoes, cherries, potatoes and strawberries. In addition, EPA has deleted the Pseudomonas syringae strain 742RS from the registration case pursuant to 40 CFR 155.42(b)(5) because all registrations of all products containing that active ingredient are cancelled. The registrant submitted a voluntary cancellation request for all products containing strain 742RS on April 7, 2008. These proposed voluntary cancellations were published (73 FR 53007, September 12, 2008 FRL-8380-7. No comments were received to support Pseudomonas syringae strain 742RS products, and they were cancelled on March 12, 2009. The exemption from the requirement of a tolerance for residues of Pseudomonas syringae strain 742RS in or on all raw agricultural commodities when applied as a frost protection agent or biological control agent to growing agricultural crops in accordance with good agricultural practices that is listed in 40 CFR 180.1114 was reassessed on June 3, 2002 and it was determined that it meets the FQPA 1996 safety standard. The Agency will take separate action to propose revision of any affected exemptions from the requirement of a tolerance for Pseudomonas syringae strain 742RS that are not supported for import use only.

9/30/09 Notice of Approval to Register New Active Ingredient: EPA has approved an application from Bedoukian Research Inc. to register the pesticide product, Bedoukian l-Carvone, a mosquito repellent comprised of oil from the spearmint plant.
9/23/09 Tolerance Exemptions Requested: EPA is announcing receipt of a pesticide petition proposing the establishment or modification of regulations for residues of pesticide chemicals in or on various food commodities. PP 9E7552. Interregional Research Project Number 4 (IR-4), Rutgers University, 500 College Rd. East, Suite 201W, Princeton, NJ 08540, on behalf of OmniLytics, 5450 W. 8/27/09 Notice of Request to Register New Active Ingredients: EPA is approving an application to register the pesticide product NEXY containing Candida oleophila strain O, a naturally occurring yeast isolated from golden delicious apples at 57%, intended for use as an antagonist to specifically control the fungal pathogens gray mold and blue mold which cause post-harvest decay on apples and pears.
8/05/09 Temporary Tolerance Exemption Granted: This regulation establishes a temporary exemption from the requirement of a tolerance for residues of the microbial pesticide, Pasteuria usgae, on strawberries when applied/used as a nematicide in accordance with the terms of Experimental Use Permit (EUP) 85004-EUP-1. MacIntosh and Associates, Incorporated, 1203 Hartford Avenue, Saint Paul, MN 55116-1622 (on behalf of Pasteuria Bioscience, Incorporated, 12085 Research Drive, Suite 185, Alachua, FL 32615) submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting the temporary tolerance exemption. This regulation eliminates the need to establish a maximum permissible level for residues of Pasteuria usgae in or on strawberries. The temporary tolerance exemption expires on December 31, 2010.

7/29/09 Temporary Tolerance Exemption Granted: This regulation establishes a temporary exemption from the requirement of a tolerance for residues of the biochemical pesticide S-Abscisic Acid, (S)-5-(1-hydroxy-2,6,6-trimethyl-4-oxo-1-cyclohex-2-enyl)-3-methyl-penta-(2Z,4E)-dienoic Acid in or on leafy vegetables,herbs and spices, pome fruit, stone fruit, grapes and pineapples when applied/used as a plant regulator in accordance with the terms of Experimental Use Permit (EUP) 73049-EUP-7. Valent BioSciences Corporation submitted a petition to EPA under the Federal Food, Drug,and Cosmetic Act (FFDCA), requesting the temporary tolerance exemption. This regulation eliminates the need to establish a maximum permissible level for residues of S-Abscisic Acid, (S)-5-(1-hydroxy-2,6,6-trimethyl-4-oxo-1-cyclohex-2-enyl)-3-methyl-penta-(2Z,4E)-dienoic Acid for the uses permitted under EUP 73049-EUP-7. The temporary tolerance exemption expires on August 7, 2012.

6/03/09 Tolerance Exemption Granted: This regulation amends the temporary exemption from the requirement of a tolerance for residues of the Aspergillus flavus AF36 (A. flavus AF36) on pistachio when applied/used as an antifungal agent to displace aflatoxin-producing fungi. Interregional Research Project Number 4 (IR-4), on behalf of the Arizona Cotton Research and Protection Council, submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting the temporary tolerance exemption be amended. The amendment extends the expiration date to December 31, 2011.
6/03/09 Notice of Approval to Register New Active Ingredient: - EPA is announcing availability of the final registration review decision for L-Lactic Acid a biochemical pesticide and an antimicrobial disinfectant. L-Lactic Acid is a low-toxicity acid that occurs naturally in several foods and is primarily found in fermented milk products. However, L-Lactic Acid also occurs naturally in meats, fruits, tomato juice, beer, wine, molasses, blood and muscles of animals, and in the soil. L-Lactic Acid is registered as a biochemical pesticide used as a mosquito attractant (in traps). In addition, L- Lactic Acid is also used as an antimicrobial disinfectant, indirect food contact surface sanitizer, fungicide, and virucide when applied to hard, non-porous surfaces such as tile, countertops, metal, or glass.

5/20/09 Tolerance Exemption Granted: This regulation establishes an 18-month exemption from the requirement of a tolerance for residues of the Bacillus thuringiensis Cry1A.105 protein in or on the food and feed commodities cotton seed,cotton seed oil, cotton seed meal, cotton hay, cotton hulls, cotton forage and cotton gin byproducts when used as a plant-incorporated protectant. 05/06/09 Notice of Approval to Register New Active Ingredients: EPA issued a notice, published in the Federal Register of September 5, 2008 (73 FR 51816) (FRL-8353-5), which announced that Bull Run Scientific, VBT, 7400 Beaufont Springs Drive, Suite 300, Richmond, VA 23225-5519, had submitted an application to register the pesticide product, Bull Run Japanese and Oriental Beetle Trap, arthropod pheromone (EPA File Symbol 84565-R), containing attractants and pheromones. This product was not previously registered. The application was approved on March 30, 2009, as Bull Run Japanese and Oriental Beetle Trap (EPA Registration Number 84565-1) for the control of Japanese and Oriental beetles.

4/29/09 Experimental Use Permit Granted: EPA has issued the following EUP: 82608-EUP-1. Issuance. AgroGreen, Biological Division, Minrav Infrastructures (1993) Ltd., 3 Habossem Str, P.O. Box 153, Ashdod, 77101, Israel, represented by SciReg, Inc., 12733 Director's Loop, Woodbridge, VA 22192, USA. This EUP allows the use of 85.84 pounds (39.02 kilograms) of the end-use product BAFI SDN (100%), containing the active ingredient Bacillus firmus isolate I-1582 for treating seeds to be planted on 7,478.25 acres of corn, cotton, and soybean to evaluate the control of nematodes. Neudorff GmbH KG Neudorff GmbH KG c/o Walter G. Talarek PC, 1008 Riva Ridge Drive, Great Falls, VA 22066-1620, had submitted an application to register the pesticide products, NEU1173H Concentrate (EPA File Symbol: 67702- EA), and NEU1173H RTU(EPA File Symbol: 67702-ET). Type of product: Herbicide. Active ingredient: Iron HEDTA (FeHEDTA) at 26.52% and 1.5% respectively. This product was not previously registered. The application was approved on December 9, 2008, as NEU1173H Concentrate herbicide, EPA Registration Number 67702-26, and NEU1173H RTU, EPA Reg. Number 67702-27 for household and commercial use as herbicides.

3/11/09 Proposed Technical Amendments - Revising Commodity Terms: The Office of Pesticide Programs (OPP) has developed a commodity vocabulary database entitled Food and Feed Commodity Vocabulary. The database was developed to consolidate all the major OPP commodity vocabularies into one standardized vocabulary. As a result, all future pesticide tolerances issued under 40 CFR part 180 will use the ``preferred commodity term'' as listed in the aforementioned database. Comments are due by May 11, 2009.

3/11/09 Experimental Use Permit Requested: Genetically Engineered Cotton Varieties - EPA has granted an experimental use permit to Bayer CropScience for the plant-incorporated protectant Bacillus thuringiensis Cry1Ab protein in events T303-3 and T304-40 cotton plants on 152 acres planted to Cry1Ab-containing cotton to evaluate the control of lepidopteran larvae such as bollworm (Helicoverpa zea) and tobacco budworm (Heliothis virescens). The program is authorized only in the States of Alabama, Arizona, Arkansas, California, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee, Texas, and in Puerto Rico and is effective from January 1, 2009 to December 31, 2010.

3/11/09 Tolerance Exemption Granted: Bacillus mycoides isolate J, a fungicide - In response to a petition from Montana Microbial Products, EPA has issued a final rule establishing a temporary Tolerance exemption from the requirement of a tolerance for residues in or on pecans, potatoes, sugar beets, tomatoes, and peppers. This temporary exemption from the requirement of a tolerance expires and is revoked on March 31, 2011

2/04/09 Request to Amend Experimental Use Permit Monsanto Company has requested an amendment and extension of permit 524-EUP-1, which was first granted by EPA on September 13, 2007 and extended on April 11, 2008. Under the existing EUP, plantings are permitted through July 31, 2009. Monsanto is now proposing to extend the experimental program until December 31, 2010 and to amend it by conducting testing with up to 0.466 pounds of Cry1Ac protein and the genetic material necessary for its production in MON 87701 soybean on 1,362 acres (282.86 acres of non-PIP and border rows are also proposed for a total of 1,644.86 acres).

1/07/09 Experimental Use Permit Amended - On July 17, 2008, EPA approved Monsanto Company's application for an EUP for the testing of the combined trait corn product MON 89034 (Cry1A.105 and Cry2Ab2) x TC1507 (Cry1F) x MON 88017 (Cry3Bb1) x DAS-59122-7 (Cry34Ab1 and Cry35Ab1) as well as other event sub-combinations through June 30, 2009, appears elsewhere in this issue of the Federal Register. Monsanto proposes amending the EUP application to allow testing on a maximum 17,777.42 total program acres with a proposed planting season from February 15, 2009 through June 13,2010.
