February 13, 1978 PSD Applicability
Determination 1.5
"Commence" construction has been
interpreted to refer only to continuous
on-site construction (i.e., significant
and continuous site preparation work
such as major clearing or excavation or
placement, assembly, or installation of
unique facilities or equipment at the
site). A contractual obligation will be
considered commencement of construction
only if its cancellation would result in
a significant loss and if it provides
for a continuous program of
construction.
