August 25, 1976 PSD Review Requirements For Modified Petroleum Refineries 1.1
A catalytic cracking unit is being
moved from Canada to Region VI where it
will be "re-erected" at an existing
petroleum refinery. Since the
installation work will begin after
6/1/75, the question is, is this unit
subject to PSD. The answer is dependent
on a number of things. If the catalytic
cracking unit will increase SO2 and/or
particulate emissions from the refinery,
then unless there is a binding contract
for continuous onsite construction
completed prior to 6/1/75, the "re-
erection" commencing after that date
would trigger the PSD review procedures.
But, if work has begun and no permit has
been granted, the owner or operator is
in violation of an implementation plan
and is subject to enforcement.
