EPA Information Related to the American Recovery and Reinvestment Act of 2009 (Recovery Act)

EPA Requirements for Projects Supported by the Recovery Act

In addition to meeting the requirements of the National Environmental Policy Act (NEPA), projects supported by the Recovery Act must also comply with applicable environmental requirements that are administered and/or overseen by EPA, including:

  • General and transportation conformity under the Clean Air Act,
  • Clean Water Act Section 402, National Pollutant Discharge Elimination System,
  • Clean Water Act, Section 404,
  • Safe Drinking Water Act, Section 1424(e), and
  • Superfund.

Below is a list of links to resources for guidance on these requirements; however, the list is not exhaustive. Note that additional federal requirements not involving EPA may apply to a given project, as well as non-federal requirements.

Air

General Conformity under the Clean Air Act – Resources to ensure that the actions taken by federal agencies in nonattainment and maintenance areas meet national standards for air quality.

Transportation Conformity under the Clean Air Act – Resources to ensure that federal funding and approval are given to highway and transit projects that are consistent with the air quality goals established by a state air quality implementation plan (SIP).

Water

Clean Water Act Section 402, National Pollutant Discharge Elimination System (NPDES) – Technical and regulatory information regarding point sources that discharge pollutants into waters of the United States through the NPDES permit program.

Clean Water Act, Section 404 – Guidance for complying with Section 404 of the Clean Water Act which regulates the discharge of dredged or fill material into the waters of the U.S., including wetlands.

Federal Facilities Restoration and Reuse Office - Provides technical and regulatory information specifically tailored for federal agencies to assist in complying with section 120 of the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (as amended by the Superfund Amendments and Reauthorization Act of 1986. The website also provides information resources ranging from the integrated risk information system to environmental justice.
