June 15, 1989 Time the State
of Virginia could finalize a BACT determination for a new emission
source 8.38
A BACT decision is not final or "locked-in" until
the final permit is issued; until that time, a
permit issuing agency is free to share a tentative
preliminary BACT determination as soon as
appropriate. An applicant does not need a final
BACT decision to conduct modeling; modeling is
based on the level of control recommended by the
applicant. Decisions on technology transfer
should be carefully scrutinized to ensure that
"reasonable technology transfer" is defined
broadly enough to prevent circumvention of use of
certain controls by selection of some slightly
different unit.
