Interim Policy on Stack Height Regulatory Actions 8.26
A Court of Appeals ruling on January 22, 1988, remanded three portions of EPA's stack height regulations. This memo discusses the impact of these changes. Permits issued under fully approved or delegated NSR and PSD programs prior to promulgation of revised rules should provide notice that any permit is subject to review and modification if the source is later found to be affected by EPA's revised rules.Notebook Entries: 11.11; 15.5A; 28.5
