April 1983 Applicability Determination for Delco Products in Dayton, Ohio 4.6

If an area is redesignated from a nonattainment to attainment, a source's emission limits can be raised above its original limits of new source requirements (LAER) and emission offset requirements. PSD would then have to be satisfied. EPA cannot require the continued application of nonattainment requirements once an area has been redesignated to attainment. If this relaxed limit will not interfere with the maintenance of the NAAQS nor any applicable air quality increment, it can be approved. Since, in this case, the change in emission limitations will result in a significant net increase in emissions, the source is requested to obtain a PSD permit and to comply with the permit requirements.
