February 24, 1989 Decision Upholding the Right of a State to Bring Suit in Federal Court as a Citizen Under the Clean Air Act 10.41

This US District Court decision upheld the right of a State to bring suit in Federal court as a citizen under the Clean Air Act (CAA). Also, although the CAA does not authorize penalties under Section 304, Michigan could collect them under the authority of the State statute. [Copy of the Decision is included]
