August 20, 1979 Permitting Multi-Phase Construction Under Prevention of Significant Deterioration Regulations 10.13

Provisions for issuing permits to phased construction projects are applicable to sources with mutually independent phases. An example of this would be a power plant with several boilers that will be constructed one at a time.

PSD permits may be issued to a multiphased source before each phase has obtained a State permit. The regulations do not require that any source obtain State permits before a PSD permit will be issued, except where offsets are required. In order for a PSD permit to remain valid, a State permit must be issued within 18 months of PSD permit issuance. In the case of phased projects the State permits for each phase must be obtained within 18 months of the date specified in the PSD permit. Plans for each phase of a construction project must be well-defined before a PSD permit can be issued.
