This is a follow-up to my March 19, 1979, memorandum on the same subject. I am attaching lists of the Federal Officials responsible for each of the mandatory Class I areas under the jurisdiction of the U. S. Forest Service and the U. S. Fish and Wildlife Service.

I have also attached a copy of a letter from the Assistant Secretary of the Department of Agriculture to the Administrator which indicates that the Chief of the Forest Service has been delegated the authority to act as the Federal Land Manager for all lands under the jurisdiction of the Forest Service. Accordingly, at the national level, notice of permit applications for a source which may affect Forest Service lands must only be provided to the Chief of the Forest Service.

We are currently in the process of developing guidance for notification procedures once the States assume the permitting authority under the PSD program. We are also considering modifications of the notification procedures while EPA retains the permitting authority. Until such modifications are made, however, you should continue to follow the procedures outlined in my March 19 memorandum.

Dear Mr. Costle:

Several sections of the Clean Air Act (CAA) require the Environmental Protection Agency (EPA) or the States to notify or consult with the Federal Land Manager (FLM), e.g., Sections 164(b)(1)(B), 165(d)(2)(A), and 169(d). In certain instances, the Federal Official (FO) must also be notified. The CAA defines the FLM as "the Secretary of the Department with authority over the United States lands involved" (Section 302(i)). The FO is not defined.

The Department of Agriculture has delegated authority for the protection, management, and administration of the National Forests, National Grasslands, and other lands administered by the Forest Service to the Chief of the Forest Service. This includes the air resources. The Chief has redelegated much of the authority for air management to the Regional Foresters in order to provide prompt consideration of management concerns at the field level. Thus, by delegation from the Department, the Chief is the FLM for lands administered by the Forest Service and, by delegation from the Chief, the Regional Foresters are the FO's.

The Clean Air Act either directly or indirectly limits the time FLM's have to comment on important matters. For example, redesignation proposals must be reviewed and commented on within a maximum of 60 days (164(b)(1)(B)) and Section 165(c) specifies that permit applications for major emitting facilities be granted or denied within one year of filing.

We request that the Chief of the Forest Service and the appropriate Regional Forester receive CAA notifications or consultations pertaining to Department lands administered by the Forest Service. This will ensure informing both the FLM and FO and enable us to provide appropriate reviews and comments on time.

Enclosed are copies of the delegations of authority; the names, addresses, and telephone numbers for the Chief and Regional Foresters; and a map showing the Forest Service Regions for distribution to the EPA Regional Offices.
