Dyes and Pigments Production Wastes

Certain nonwastewaters from the production of specific dyes, pigments, and food, drug, and cosmetic colorants (FD&C) are being added to EPA’s codified list of hazardous waste as K181. While listed hazardous waste must be strictly managed, this listing provides a flexible approach that focuses on total quantities of chemical constituents of concern in a waste that present the greatest risk to human health and the environment.

Wastes that contain less than the specified threshold levels of constituents of concern on a yearly basis are not hazardous (e.g., aniline levels below 9,300 kg/yr). Moreover, waste sent for disposal in landfills that meet specific design standards is exempt from hazardous waste management. Waste that is not disposed of in such landfills and that meet or exceed the specified thresholds for any of the specific constituents of concern must be managed as listed hazardous waste K181.

This rule also establishes treatment standards for disposal of these wastes and designates the wastes as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA or Superfund).

Hazardous Waste Listing Determination for Dyes and Pigments Production Wastes; Proposed Rule - November 25, 2003

EPA proposed to list nonwastewaters from the production of certain dyes, pigments and FD&C colorants as hazardous wastes under the Resource Conservation and Recovery Act (RCRA), which directs EPA to determine whether these wastes present a hazard to human health or the environment. EPA proposed a mass loading-based approach for these wastes. Under this approach, these wastes are hazardous if they contain any of the constituents of concern at annual mass loading levels that meet or exceed regulatory levels.
