Dear Mr. Frey:

Based on the outcome of our Project XL meeting in your office on July 8, and the joint draft (final response was never received) response from the involved regulatory agencies to the six questions asked in my June 17, 1996 letter to Mr. William Patton, Region IV, USEPA, it is apparent that it would be virtually impossible to obtain a completed/approved Final Project Agreement (FPA) in any reasonable timeframe if we were to continue with our original broadbased proposal.

Even though we continue to feel that our original accepted proposal satisfies all 8 EPA criteria for Project XL and compares favorably with any other XL proposal to date, we are proposing to narrow the scope of the proposal (propose language in initial FPA to allow future phases to incorporate areas deleted) to be around the land application site only. The attached information helps define the proposed reduced scope Project XL.

Included in the attached information is a proposed agenda for our meeting on Wednesday, July 24. It is our intent to jointly decide at this meeting whether to proceed with any agreed upon reduced scope Project XL.
