WHAT IS PROJECT XL?
Project XL, which
stands for "excellence and Leadership," is a national
initiative that tests innovative ways of achieving better and
more cost-effective public health and environ mental protection.
The information and lessons learned from Project XL will be used
to assist EPA in redesigning its current regulatory and policy-sefting
approaches. Project XL encourages testing of cleaner, cheaper,
and smarter ways to attain environmental results superior to those
achieved under current regulations and policies, in conjunction
with greater accountability to stakeholders. Project XL has committed
to a goal of 50 pilot projects- Because of it's limited scope,
it is vital that each project tests new ideas with the potential
for wide application and broad environmental benefits. As of August
1998, eight pilot experiments are being implemented and twenty
additional projects are currently being developed.
SUMMARYOF
THE LUCENT
PROJECT
The Microelectronics business unit
of Lucent Technologies designs and manufactures integrated circuits
and optoelectronic components for the computer and communications
industries. The " umbrella" Final Project Agreement
(FPA) is based on an existing, thirdparty certified, ISO 14001
Environmental Management System (EMS) for the entire, global microelectronics
business unit of Lucent Technologies, and contemplates the development
of specific proposals for regulatory flexibility and superior
environmental performance at individual facilities. The "umbrella"
FPA outlines a process that allows Lucent to use its EMS as a
framework for developing specific proposals to simplify permitting,
recordkeeping, and reporting requirements, while driving continual
improvement and pollution prevention programs. The "umbrella"
FPA provides a "test bed" for the use of a high-quality
ISO 14001 EMS as a vehicle for determining and managing regulatory
flexibility while achieving superior environmental performance.
SUPERIOR
ENVIRONMENTAL
PERFORMANCE
The "umbrella" FPA is a
multi-regional attempt to incorporate high-quality environmental
management practices, through Lucent's EMS, across the entire
business unit. This will drive multi-media superior environmental
performance. The parties anticipate that the EMS will foster superior
environmental performance by identifying opportunities to reduce
Lueent's environmental impacts in a variety of areas, both regulated
and non-regulated. EPA Regions 3 and 4 are intended sites for
facility-specific projects. Facility-specific addenda to the umbrella
agreement will be the vehicles for achieving superior environmental
performance and considering regulatory flexibility at individual
facilities.
FLEXIBILITY
The "umbrella" FPA does
not address any specific regulatory flexibility, but discusses
potential flexibilities in permitting, permit modification. compliance
monitoring, and record keeping requirements under Title V of the
Clean Air Act, the Clean Water Act, and RCRA- Specific instances
of regulatory flexibility will be discussed in each facil4-specific
addendum. The first candidate for a facility-specific addendum
is Lucent's Allentown, Pennsylvania facility.
STAKEHOLDER
INVOLVEMENT
As part of its EMS, Lucent has established
facility-specific Local Environmental Advisory Groups (LEAGS)
for all of its facilities globally. Each LEAG is composed of local
stakeholders including environmental organizations, community
groups, employees, and other interested citizens. The LEAGs provide
input on the XL project and the facilitiy's EMS as both are implemented.

superior environmental performance in both regulated and non-regulated
areas and drive environmental management toward continuous improvement
* What characteristics of an EMS
are necessary to provide superior environmental performance?
* How can EPA regulations be crafted
to allow a company with a high quality EMS to best implement projects
arising from the EMS?
