SUBJECT: Overview of 3M Hutchinson MinnesotaXL Permit

 

I. Introduction.

In this presentation I will provide an overview of the innovative permitting concept referred to as "Project XL." The XL refers to eXcellence and Leadership. The 3M Hutchinson pilot project developed by the MPCA and 3M is the first in the nation to move forward into a public notice.

Attached are the following five documents pertaining to the implementation of the 3M Hutchinson Pilot Project:

1 . 3M Hutchinson Presentation Slides - contains copies of the slides for this informational board item which will be presented by Lisa Thorvig.

2. 3M Hutchinson Final Project Agreement - describes: the development of the 3M Hutchinson Pilot Project; permits combined; proposed rule variances; superior environmental performance; operational flexibility proposed for 3M; and how we intend to measure the success of the project.

3. 3M Hutchinson MinnesotaXL Permit - contains the limits and enforceable requirements that will apply to the 3M Hutchinson facility.

4. 3M Hutchinson Technical Support Document to Air Quality Issues - outlines the technical details of how the air quality limits and requirements are supported.

5. 3M Hutchinson Pilot Project Fact Sheet - overviews the 3M Hutchinson pilot project.

3M is committing to report emissions of toxic chemicals in such a manner MPCA can assess its emissions to assure that they do not exceed state guidelines and to take corrective action in the event guidelines are exceeded. 3M is also committing to develop an acceptable acute chemical release procedure. 3M is seeking relief from some of the hazardous waste generator and management requirements in order to achieve additional reuse and recycling of hazardous wastes and manage its hazardous waste operations more cost effectively. 3M is committing to develop and implement an environmental management system (EMS) to verify its compliance with the MinnesotaXL permit and to test whether an EMS provides better environmental or management results than current regulatory requirements. 3M is committing to develop a simplified and understandable compliance reporting system on the Internet so that the public as well as the regulatory agencies are aware of 3M's performance under the MinnesotaXL permit

Under the 3M Hutchinson final project agreement, 3M is committing to establish environmental improvement goals and measurement methods to determine actual performance in meeting the goals. The environmental improvement goals will include goals for preventing or reducing pollution, and may include goals for reducing energy and water use, criteria air pollutants, water pollutants and solid waste generated from manufacturing operations. 3M is also committing to report annually an assessment of the success of the 3M Hutchinson XL pilot.

In order to implement this project, 3M is requesting regulatory flexibility from certain state and federal air quality permitting requirements, new source performance standards, air toxics standards under NESHAPs for source categories, hazardous waste generator standards, general conditions found in air and water regulations, emergency response planning requirements, and reporting and recordkeeping requirements. In addition, 3M is requesting regulatory flexibility from state liquid storage facility requirements.
