Re: Lucent Technologies/Project XL

Dear Dr. Morris:

We have received your letter of April 3, 1997. In your letter, USEPA for the first time has responded to our repeated requests -- dating back to June 1996 and most recently expressed in our March 14, 1997 letter to you -- to state the Agency's position in writing regarding information sharing and enforcement response in Lucent Microelectronics' XL Project. Your letter raises a number of completely new and critical issues regarding the structure and implementation of our XL Project and, more specifically, the scope of USEPA's role in it.

Since we received your letter on Friday afternoon, less than two working days before our scheduled meeting on April 8th, and because the critical management at Microelectronics is currently unavailable or out of the country, we are not in a position to formulate a response to these new issues prior to tomorrow's scheduled meeting. Accordingly, given the gravity of these new issues you have raised, we do not believe it would be productive to meet tomorrow.

As we develop our response to your letter, we will continue to operate our fully-certified, business-wide ISO 14001 environmental management system at Microelectronics facilities across the globe in cooperation with our other Project XL Partners (the States and ELI) and our local community stakeholder groups. It is unfortunate that USEPA has not been able to rejoin our Project Partnership's innovative work, including participation in setting our objectives and targets for FY 1998 at this month's Microelectronics' Environmental Action Team meeting.
