Revision to the Research, Development and Demonstration (RD&D) Permits Rule for Municipal Solid Waste Landfills.
The EPA Administrator, Gina McCarthy, signed the Revision to the Research, Development and Demonstration Permits Rule for Municipal Solid Waste Landfills final rule is on March 21, 2016 and it was submitted for publication in the Federal Register (FR).
This final rule allows Research, Development and Demonstration (RD&D) permits for municipal solid waste landfill bioreactors to be extended from 12 to up to 21 years. The rule allows directors of EPA approved state waste programs to increase the number of renewals for such permits from three to six.
While EPA has taken steps to ensure the accuracy of this Internet version of the rule, it is not the official version of the rule for purposes of compliance. Please refer to the official version in a forthcoming FR publication, which will appear on the Government Printing Office's FDsys website and on Regulations.gov in Docket No. EPA-HQ-RCRA-2015-0126. Once the official version of this document is published in the FR, this version will be removed from the Internet and replaced with a link to the official version.

Summary of Final Rule
EPA revised the Criteria for Municipal Solid Waste Landfills (MSWLF) to allow states to issue research, development, and demonstration (RD&D) permits for new and existing MSWLF units and lateral expansions. This rule allows Directors of approved state programs to provide a variance from certain MSWLF criteria, provided that MSWLF owners/operators demonstrate that compliance with the RD&D permit will not increase risk to human health and the environment over compliance with a standard MSWLF permit. EPA finalized this alternative permit authority to promote innovative technologies associated with landfilling of municipal solid waste. RD&D permits may provide a variance from existing requirements for run-on control systems, liquids restrictions, and the final cover requirements.

Summary of Proposed RuleThe EPA proposed to add a new section to the Criteria for Municipal Solid Waste Landfills (MSWLF) to allow states to issue research, development and demonstration (RD&D) permits for landfill operations at variance with some parts of the MSWLF criteria under 40 CFR Part 258, provided landfill operators demonstrate that these operations will not result in an increased risk to human health and the environment. EPA proposed this alternative to promote innovative technologies for the landfilling of municipal solid waste. Variance from the following MSWLF criteria would not be allowed: location restrictions, ground water monitoring, corrective action requirements, the financial assurance criteria, procedures for excluding hazardous waste, and explosive gases control requirements.
