The U.S. EPA is issuing a notice of proposed action under the Clean Water Act. The USEPA is proposing to issue a renewal to National Pollutant Discharge Elimination System (NPDES Permit No. NN0020133) to:

The Nacogdoches Oil and Gas (“NOGI”) English Lease Boundary Butte Field is located on the Navajo Nation in San Juan County in Southwestern Utah. The proposed permit is for the discharge of treated effluent from Battery No. 1 and Battery No. 3 via Outfall No. 001 and Outfall No. 002 respectively to unnamed tributaries to Gothic Creek which is a tributary of the San Juan River. Process water from the batteries is separated from oil using heat treaters then allowed to settle in a series of settling ponds before being discharged. The ponds are skimmed to remove the floating layer of petroleum called emulsion which is stored in on-site tanks which are pumped and the emulsion transported off-site when the tanks are full. The average flow from Outfall No. 001 is 8,000 gallons per day with a maximum flow of 80,000 gallons per day. The average flow from Outfall No. 002 is 4,000 gallons per day with a maximum flow of 40,000 gallons per day.
