Notice of Proposed Action

The U.S. EPA is issuing a notice of proposed action under the Clean Water Act. The USEPA is proposing to issue a renewal to National Pollutant Discharge Elimination System (NPDES Permit No. NN0029386) to:

Chevron Mining Incorporated McKinley Mine remediation
24 miles Northwest of Gallup, NM on Hwy 264
Gallup, New Mexico 87305

The McKinley Mine site is located on the Navajo Nation in McKinley County in Northwestern New Mexico. Mining operations at the site have ceased and the site is undergoing standard post-mining remediation as required by the Office of Surface Mining. The proposed EPA NPDES permit is for the discharge of treated runoff from the mine remediation project via 67 outfalls numbered 003 thru 076, to Defiance Draw, Tse Bonita Wash, and Coal Mine Wash, three tributaries of the Rio Puerco. Runoff from the site is channeled to settling ponds before being discharged. The flow from these outfalls is rain-dependent and variable.
