Public Notice: Palmdale Energy Project; Announcement of Decision to Rescind a Clean Air Act Prevention of Significant Deterioration (PSD) Permit

Summary

On March 2, 2020, the United States Environmental Protection Agency, Region 9 (EPA) rescinded a Clean Air Act Prevention of Significant Deterioration (PSD) permit that it had earlier issued granting conditional approval to Palmdale Energy, LLC (Permittee) for the Palmdale Energy Project (Project), in accordance with the PSD regulations (40 CFR 52.21). PSD Permit No. SE 17-01, issued by the EPA on October 25, 2018, had authorized the Permittee to construct and operate the Project, which included two natural gas-fired combustion turbines, an auxiliary boiler, two emergency engines, circuit breakers, and other equipment with fugitive emissions. The address for the Permittee is 801 Second Avenue, Suite 800, Seattle, WA 98104. The proposed location for the Project was 950 East Avenue M, Palmdale, California 93440.

On February 28, 2020, the EPA received a letter from the Permittee requesting that the EPA rescind the PSD permit issued to the Permittee for the Project. According to the letter, the Permittee had not begun construction of the Project and had decided to cancel the Project. The letter stated that because the Project would not be constructed or operated, it no longer required a PSD permit. Additionally, at the request of the Permittee, the California Energy Commission terminated the license for the Project on February 20, 2020. Based on the information provided in the request, the EPA determined that the request met the criterion for PSD permit rescission in 40 CFR 52.21(w)(3). Accordingly, on March 2, 2020, the EPA issued a letter to the Permittee rescinding the Permittee’s PSD permit for the Project.
