Summary
EPA is soliciting public comments on EPA’s action to add five waterbody-pollutant combinations to Arizona’s 2018 Clean Water Act section 303(d) list of waters requiring a total maximum daily load (303(d) List). On August 20, 2018 Arizona Department of Environmental Quality submitted its 303(d) List under Clean Water Act section 303(d)(2). This section requires that states submit and EPA approve or disapprove lists of waters that do not meet water quality standards, where existing technology-based pollution controls are not stringent enough to attain, or maintain, state water quality standards, and for which a TMDL must be prepared.
On September 14, 2018, EPA determined that Arizona's 2018 303(d) List partially met the requirements of Clean Water Act Section 303(d), and approved each of the State's listings included in its 2018 303(d) List. During its review, EPA also identified several waters and associated pollutants that met federal listing requirements but were not included in Arizona’s 303(d) List. Accordingly, EPA has identified additional waterbody-pollutant combinations as requiring a TMDL.
After considering public comments, U.S. EPA will make any necessary adjustments to its decision and transmit the final 303(d) List to the State. EPA’s determination and the waterbody-pollutant pairs that EPA is adding to the 303(d) List are available below.
