Background

Waste Management of Wisconsin, Inc. (WMWI) Ridgeview Recycling and Disposal Facility (RDF) is an existing landfill approved by Wisconsin Department of Natural Resources (WDNR) as a disposal facility.  The landfill complies with the requirements of Subtitle D landfills as implemented under NR 500, Wisconsin Administrative Code (WAC). WDNR approved the plan of operation for the Southern Expansion on April 28, 2008 and issued Amended Conditional Plan of Operation Approvals on May 9, 2011; April 16, 2012; and February 7, 2014.  The Amended Conditional Plan of Operation allows, under certain conditions, acceptance of dredged sediments that contain less than 50 parts per million (ppm) PCBs at the Southern Expansion.

WMWI asked the EPA for an approval to accept dredged material from the Cedar Creek Superfund Project for disposal at the RDF landfill. The dried and processed sediment would have a PCB concentration of less than 50 parts per million.  After reviewing WMWI’s request, EPA plans to approve the application. The Agency believes that the company has shown its plan does not present a risk to people or the environment. The approval details specific conditions under which WMWI may operate its facility. Federal law requires EPA approval because some of the Cedar Creek sediment that WMWI proposes to accept may have PCB concentrations higher than 50 parts per million before it is dried and processed for disposal. WDNR will issue another amended authorization for the Cedar Creek sediments after EPA issues its approval.

WMWI was granted a similar risk-based disposal approval to accept sediments from the Fox River Superfund Project. The Approval was issued on September 18, 2012.  During the approval process, EPA performed a detailed review of the Southern Expansion’s location, design, monitoring program, and closure requirements. 

EPA took comments from the public on the proposed approval for WMWI RDF located at 6207 Hempton Lake Road, Whitelaw, Wisconsin. The draft PCB risk-based disposal approval was open for public comment from March 16 to April 16, 2017. Copies of the draft PCB risk-based disposal approval and supporting documents (i.e., WMWI application) are located at the Manitowoc Public Library. Comments are being accepted on the draft approval. Before a final decision is made, EPA will review and respond to any and all comments from the public on the proposed approval for WMWI RDF.
