Public Notice: Michigan Disposal Waste Treatment Plant (US Ecology)

Background

The US Ecology, Michigan Disposal Waste Treatment Plant (MDWTP) facility would be allowed to operate as a commercial polychlorinated biphenyl (PCB) storage facility and treat wastes containing PCBs under the Toxic Substances Control Act (TSCA) if a proposed approval is granted from the U.S. Environmental Protection Agency (EPA).

MDWTP is a Resource Conservation and Recovery Act (RCRA) hazardous waste storage and treatment facility. MDWTP operates under a RCRA permit issued by the Michigan Department of Environmental Quality (MDEQ). MDWTP receives solid and liquid hazardous and non-hazardous waste for storage and treatment.  RCRA characteristic and listed hazardous wastes are received at the facility. Treatment conducted at MDWTP includes stabilization, chemical oxidation, chemical reduction and microencapsulation. 

EPA received an application from MDWTP for PCB commercial storage and EPA has determined the company has shown the operation does not present a risk to human health or the environment. PCB commercial storage approvals are regulated under TSCA and not RCRA. TSCA is not delegated to the states. RCRA is delegated to the states. Therefore, PCB storage approvals are issued by EPA, a federal agency and not MDEQ, a state entity.   

The proposed EPA Approval would allow MDWTP to store up to 41,460 gallons of PCBs in a combined PCB/RCRA storage area; up to 194,940 gallons of PCBs in bulk treatment tanks in a treatment building; and up to 194,940 gallons of PCBs in bulk treatment tanks in a second treatment building.  In addition, MDWTP would be allowed to treat RCRA hazardous wastes that also contain PCBs. Treatment allowed would include stabilization or microencapsulation to meet RCRA disposal requirements for RCRA characteristic or listed hazardous wastes; addition of reagents to improve physical properties to facilitate land disposal; and solidification which is defined as the addition of reagents to a waste with mechanical mixing for the purpose of reducing free liquid content in the waste.

Before a final decision is made, EPA took comments from the public on the proposed approval for MDWTP located at 49350 North I-94 Service Drive, Belleville, Michigan.

The draft PCB commercial storage approval was open for public comment from June 7, 2018 to July 10, 2018. Copies of the draft PCB commercial storage approval and supporting documents (i.e., MDWTP application) are located at the Belleville Area District Library as well as posted online (see below). Comments were accepted on the draft EPA approval, not the supporting documents.  EPA also considered requests to hold a public meeting.
