Summary
EPA is providing notice of a proposed administrative penalty settlement with Unitek Environmental Guam (Respondent) for violations of the Clean Water Act (CWA) at its facility located in Piti, Guam. In accordance with Section 309(g) of the Clean Water Act (CWA), 33 U.S.C. § 1319(g), and the Consolidated Rules of Practice at 40 C.F.R. Part 22, EPA and Respondent have entered into a Proposed Expedited Settlement Agreement (ESA) to simultaneously commence and conclude this CWA Class I civil administrative penalty proceeding. Under the Proposed ESA, Respondent will pay the United States a civil penalty of $3,350 to resolve this matter.

Description of Business or Activity Conducted by the Respondent: The Respondent owns and operates a mobile treatment plant that removes oil from bilge water and oily wastewater.
Summary of Alleged Violations: Respondent discharges treated oily water and treated bilge water to the Philippine Sea/Apra Harbor as authorized by Clean Water Act National Pollutant Discharge Elimination System (NPDES) Permit No. GU0020346. The Respondent discharged treated wastewater in excess of applicable effluent limitations and submitted late discharge monitoring reports. The Respondent has implemented corrective actions and has returned to compliance.
