CAIR Frequent Questions – State Process

Q: Will states need to seek delegation of the CAIR and CAMR programs? Will states need to amend the Title V program to incorporate CAIR and CAMR into it?

A: No. States do not need to seek delegation with regard to permitting. In particular, the permitting requirements of CAIR and CAMR do not require the States to seek delegation authority of the Title V program. States should consider whether they need to amend their existing Title V regulations in order to comply with the permitting requirements of CAIR and CAMR. EPA recommends the States review the permitting requirements of CAIR and CAMR and then determine whether their state regulations need to be amended.
