Regional Hearing Clerk
The Regional
Hearing Clerk (RHC) maintains all official administrative records of cases
in adjudication under various federal laws, the Administrative
Procedure Act (APA) and non-APA provisions of the "Consolidated Rules of Practice Governing
the Administrative Assessment of Civil Penalties, Issuance of Compliance
or Corrective Action Orders, and the Revocation or Suspension of Permits" found at 40 C.F.R. Part 22.
In this capacity, the RHC serves as custodian of these records and is
responsible for maintaining security of confidential information contained
therein.
Additionally, the RHC receives all motions, legal documents and correspondence intended to be filed in administrative cases, and makes preliminary determinations regarding compliance with applicable regulations and legal filing requirements. The RHC processes requests for adjudicatory hearings by forwarding them, along with the case file, to the Regional Judicial Officer or Chief Administrative Law Judge, as appropriate, and thereafter notifies the parties of the necessary hearing information.
Documents filed in any proceeding are open for public inspection and copying, upon request to the RHC, during normal business hours, subject to provisions of law restricting public disclosure of confidential information. The person seeking copies will be responsible for reproduction costs incurred. The RHC is also available as a resource to both regional staff and the general public seeking information contained in the administrative case files, as well as advice on the proper filing of documents.
