Hazardous Waste Storage Permit To Be Reissued, Safety-Kleen Systems, Inc., Davenport, Scott County, Iowa

INTRODUCTION

The U. S. Environmental Protection Agency (EPA) proposes to reissue a hazardous waste storage permit (Permit) under the Resource Conservation and Recovery Act to Safety-Kleen Systems, Inc. (Safety-Kleen) for its facility located at 3035 West 73rd Street, Davenport, Iowa. The draft Permit is being made available to the public for review and comment.

The draft Permit is at the Davenport Public Library, Main Street Branch, 321 North Main, Davenport, Iowa. A public comment period will be held from July 18, 2011 to August 31, 2011, to give the public an opportunity to comment on the draft Permit.

This Permit allows the Facility to continue to operate an existing hazardous waste storage facility. The Facility is allowed to store hazardous waste in an above ground tank unit and a container storage unit. The Permit has conditions which require the Facility to properly operate, inspect, and maintain the storage units. The tank unit and container storage unit each have adequate secondary containment.

The facility may accept hazardous wastes generated from off‑site customers. This Permit also requires the Facility to conduct all necessary activities to investigate releases of hazardous waste and hazardous constituents from areas at the facility where wastes were managed and might have been released. The Facility is also required by this Permit to respond to or clean up any release of hazardous waste or hazardous constituents determined to have occurred.

BACKGROUND

The Facility consists of two buildings, each with offices. One of the buildings includes the hazardous waste container storage unit and a solvent return and fill station with a loading dock. The Facility also has two tank farms. One of the tank farms includes the one above ground hazardous waste storage tank. This Facility is a collection point for hazardous wastes generated by customers. All hazardous wastes are ultimately transported to a Safety-Kleen recycling facility or other permitted facility. The Facility is located in Scott County, is approximately 2.2 acres, and is zoned for light manufacturing.

The Facility has been operating as a storage facility since August 1980. The Permit was originally issued by EPA to the Facility and became effective on March 31, 1992. The original Permit included conditions for the Facility to operate two container storage units and two above ground storage tanks, all used for hazardous waste storage. One container storage unit and one tank unit have since been closed and cleaned to EPA specifications, and were removed from the Permit.

The draft Permit will be issued to allow the Facility to continue to accept hazardous waste from off-site customers. The draft Permit includes conditions allowing temporary storage of the hazardous waste in the above ground tank unit and the container storage unit. The draft Permit also requires the Facility to conduct investigations. Based on the investigation information submitted by the Facility, EPA will determine the additional investigations and/or actions that need to be taken at the Facility.

ADDITIONAL INFORMATION

A formal public hearing has not been scheduled but will be held if there is sufficient public interest. Request for a public hearing must be made in writing to the EPA contact listed below and must state the nature of the issues to be raised at the hearing. EPA will evaluate any request and hold a formal hearing if it finds that a hearing will contribute to the decision-making process by clarifying significant issues affecting the permit. EPA will make a final permit decision only after the public comment period ends and all comments are reviewed. EPA may modify the draft Permit based on any new information and comments from the public.
