Class III Permit Modifications Proposed with Comment Period and Availability Session, Exline, Inc. Facility, Salina, Saline County, Kansas

INTRODUCTION

The U.S. Environmental Protection Agency (EPA) Region 7 invites the public to comment on the proposed Resource Conservation and Recovery Act (RCRA) Hazardous Waste permit modifications for the Exline, Inc. (Exline) facility in Salina, Kansas.

The comment period begins March 9, and ends May 8, 2011. A formal public hearing has not been scheduled, but will be held if there is sufficient public interest. Comments or requests for a hearing should be submitted by May 8, 2011, and should be sent to:

BACKGROUND

The Exline facility has been operating at the present location since 1942. During historic operations, the facility repaired industrial engines and engine parts. Part of these operations included chrome plating activities.

EPA and Exline, Inc. will hold a public availability session, to provide information and answer questions regarding the proposed draft permit modifications to the Exline RCRA permit. Tanks and containers used to manage chrome plating wastes at the facility were removed under a RCRA closure plan. The RCRA program regulates facilities that use, treat or store hazardous chemicals.

Because hazardous waste constituents remain onsite in soils and ground water, Exline is required to maintain a RCRA post-closure permit which requires them to identify and, if necessary, perform corrective action in case of a release of hazardous waste to the environment.

PROPOSED PERMIT MODIFICATIONS

The current RCRA post-closure permit for Exline was issued November 2002. In December 2009, the permit was modified to require cleanup of hazardous soil contamination at several locations, and was modified to include soil cleanup standards for each contaminant. Since that time, EPA has gathered and evaluated new information concerning these standards. The following permit modifications are proposed:

  1. EPA proposes to modify the Permit to change the residential (i.e., unrestricted use) hexavalent chromium cleanup standard for soil.
  2. Exline proposes to modify the Permit to change the industrial and residential arsenic cleanup standards for soil.

PUBLIC COMMENTS

EPA encourages the public to review the Administrative Record and comment on the proposed permit modifications. A formal public hearing has not been scheduled, but will be held if there is sufficient public interest. Comments or requests for a hearing should be submitted to Lisa Gotto by May 8, 2011.

Guidelines for Commenting:

A public availability session is scheduled for March 31, 2011, at the Salina Public Library; 301 W. Elm Street; Salina, Kansas. Requests for a public hearing must be made in writing to Lisa Gotto, EPA, at the address listed on page one, and must state the nature of issues to be raised at the hearing. EPA will evaluate any request and hold a formal hearing if it finds that a hearing will contribute to the decision-making process by clarifying significant issues affecting the cleanup remedy.

EPA will make final decisions on the permit modifications only after the public comment period ends and all comments are reviewed.

Individuals may write to Lisa Gotto, EPA, to join the mailing list. Joining the mailing list will allow an individual to receive any updated information directly throughout the cleanup process.
