Corrective Action Permit To Be Issued, E. I. duPont DeNemours & Company, Inc., Ft. Madison, Lee County, Iowa

INTRODUCTION

The U. S. Environmental Protection Agency (EPA) proposes to issue a corrective action hazardous waste management permit (Permit) under the Resource Conservation and Recovery Act to the E. I. duPont DeNemours & Company, Inc. (DuPont) for the facility located at 801 – 35th Street, Ft. Madison, Iowa (Facility).  This document is available to the public for review and comment.

The draft Permit is at the Ft. Madison Public Library, 1920 Avenue E, Ft. Madison, Iowa.  A public comment period will be held from June 14 to July 29, 2010, to give the public an opportunity to comment on the draft Permit.

This Permit requires the Facility to conduct all necessary activities to investigate releases of hazardous wastes and hazardous constituents from areas at the facility where wastes were managed and might have been released.  The Facility is also required by this Permit to respond to or clean up any release of hazardous wastes or hazardous constituents determined to have occurred.

BACKGROUND

The Facility consists of several buildings on approximately 109 acres which are used for the manufacturing of resins and inks.  The Facility is surrounded by agricultural lands and undeveloped woodland to the north and west, a mobile home park to the northwest, and residential property to the east and south.  The site is situated along the northeastern edge of the City of Ft. Madison, and is approximately 3,000 feet north-northwest of the Mississippi River. 

The Permit was originally issued by EPA to the Facility on September 28, 1992, and, at the time of issuance, included conditions for the Facility to operate three container storage units and two above ground storage tanks, all used for hazardous waste storage. These units have since been closed and cleaned to EPA specifications, and are removed from this draft Permit.  The original Permit also required the Facility to conduct investigations of areas where hazardous waste releases might have occurred and to respond to such releases.  The investigation work is nearing completion.

This draft Permit will be issued for the remaining corrective action activities for the identified areas at the Facility.  Based on the investigation information submitted by the Facility, EPA will determine additional investigation and/or actions that need to be taken at the Facility.

ADDITIONAL INFORMATION

A formal public hearing has not been scheduled but will be held if there is sufficient public interest.  Request for a public hearing must be made in writing to the EPA contact listed below and must state the nature of issues to be raised at the hearing.  EPA will evaluate any request and hold a formal hearing if it finds that a hearing will contribute to the decision-making process by clarifying significant issues affecting the permit.  EPA will make a final permit decision only after the public comment period ends and all comments are reviewed.  EPA may modify the draft permit based on any new information and comments from the public.
