Non-commercial and Home Biodiesel Regulations
What Environmental Regulations Apply?
- No matter how much or how little biodiesel you produce, you have a "General Duty" to prevent accidents and to minimize the consequences of accidental chemical releases which occur, in accordance with the Clean Air Act Section 112 (r)(1).
- If there is an accident involving 5,000 pounds (760 gallons) or more of methanol, the owner is required to report the accident to the National Response Center at (800) 424-8802, their Local Emergency Response Committee (County), and the State Emergency Response Commission1. If you are using 760 gallons or more of methanol, you will want to keep the phone numbers for these agencies readily available and/or stored in your cell phone.
- If there is an accident involving 100 pounds (9.5 gallons) or more of glycerin, the owner is required to report the accident to the National Response Center at (800) 424-8802, their Local Emergency Response Committee (County), and the State Emergency Response Commission2. If you generate 9.5 gallons or more of glycerine waste, you will want to keep the phone numbers for these agencies readily available and/or stored in your cell phone.
- If you use 25,000 pounds (3,800 gallons) or more of methanol in one year, you are required to report your use of methanol by July 1st for the preceding year to the Toxic Release Inventory.2
- If you have more than 10,000 pounds of any chemical and are required to have a Material Safety Data Sheet (MSDS) for that chemical3, you will need to report the initial storage within 60 days and then by March 1st of every year to your local fire department, your Local Emergency Planning Committee, and your State Emergency Planning Commission.4
- You may be required to have a Spill Prevention, Control, and Countermeasure Plan if you store more than 1,320 gallons of oils.
- Oil spills that may be harmful must be reported to the National Response Center5 at (800) 424-8802.
- You will need to assign Renewable Identification Numbers (RINs) to your biodiesel batches if you make 10,000 gallons or more a year, as required by the Renewable Fuel Standard.
