S.D. Myers, Inc.
S.D. Myers, Inc. is proposing to remove the ban on imports of PCBs so that they can accept these materials for recycling from Canada and Mexico. SDMI has a technology that they claim will eliminate PCBs from the environment via "recycling." They suggest that their method of disposal via recycling and total thermal destruction is environmentally preferable to the current management methods available in either Mexico (unregulated burning) or Canada (land disposal). EPA promulgated rules [40 CFR 761.20(b)(1)] in 1979 based upon the Toxic Substances Control Act that banned the import and export of PCBs, but allowed a one-year moratorium on that ban. The moratorium expired before EPA promulgated rules that would specify conditions for lifting the ban (as EPA had published that they wanted to do).
