City of Kokomo, Indiana

In the late 1970s, the City of Kokomo, Indiana, entered into agreements with various waste disposal companies to dispose of sludge from Kokomo's publicly owned treatment works (POTW) at the Four County Landfill (the Site), even though the sludge was not a hazardous waste. Currently, the Site is the subject of a Remedial Investigation/Feasibility Study (RI/FS) which is being conducted by the City and other waste contributors (the Four County Group) in accordance with an Agreed Order entered into with the Indiana Department of Environmental Management (IDEM). The Four County Group has volunteered to undertake site maintenance activities, including leachate collection and disposal which will continue indefinitely in the future as a maintenance cost at the Site, even after the remedy has been completed. As its Project XL alternative, the City of Kokomo proposes to treat the leachate from the Site at its POTW, pursuant to the permit-by-rule provision of §40 CFR 270.60(c). The City of Kokomo suggests that its Project XL proposal will (a) eliminate the injection of the leachate into the environment, (b) prevent the release of air pollutants which result from trucking the leachate for the Site to a deep injection well hundreds of miles away in Ohio, and (c) enhance the environment by treating the leachate and incorporating the treated solids into Kokomo's POTW sludge recycling/composting program.
