NOTICE OF INTENT TO DEVELOP A PROJECT XL/ENVVEST FINAL PROJECT AGREEMENT BETWEEN: THE UNITED STATES AIR FORCE, AIR FORCE MATERIEL COMMAND, REGION 6 OF THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY, AND THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION.

This public notice is to notify the local community and seek out stakeholder and interested party involvement and support during the development of a Final Project Agreement (FPA) for The United States Air Force, Air Force Materiel Command's (AFMC) Project XL/ENVVEST. The goal of this notice is to inform and seek out stakeholder involvement during the development and implementation phases of this project. Parties interested in providing comment to the process should contact one of the individual listed below. On May 23, 1995 (see Federal Register Vol. 60 p. 27282) , the United States Environmental Protection Agency (EPA) announced Project XL, a new environmental initiative that provides opportunity to demonstrate excellence and leadership through the flexibility to develop alternative strategies that will replace or modify specific regulatory requirements on the condition that they produce greater environmental benefits. Further, regulated entities are challenged to develop more effective or efficient means of verification of environmental results. As part of this initiative, the President directed EPA to work with other Federal agencies that have environmental responsibilities to ensure that their programs achieve environmental results in the most cost-effective manner, while eliminating needless procedures. Consequently, the Department of Defense (DoD) and EPA signed a Memorandum of Agreement for Regulatory Reinvention Pilot Projects, or Project ENVVEST, for application at DoD managed facilities. Air Force Plant Number 4 (AFP4) was selected by AFMC to participate in Project ENVVEST. ENVVEST project development mirrors the XL process by using the same regulatory staff, development process, and project agreements.

AFP4 in Fort Worth, Texas is owned by AFMC and operated by Lockheed Martin Tactical Aircraft Systems (LMTAS). AFP4 proposes to substantially reduce ozone precursor emissions (NOx) from industrial boilers by using money saved from regulatory relief to complete installation of two new state-of-the-art low NOx industrial boilers. The requested regulatory relief consists of elimination of the requirement to install new paint booth two-stage air filters as required by the Aerospace National Emissions Standards for Hazardous Air Pollutants (NESHAP). Additionally, AFP4 proposes to eliminate or reduce inorganic HAP emissions in quantities greater than that normally achieved by strict compliance with the NESHAP. If successful, AFP4's reduction of HAP emissions through pollution prevention could be transferable to other aerospace manufacturing facilities and many of DoD's aircraft facilities such as Air Force, Navy, Reserve, and Air National Guard bases and maintenance depots.

The FPA will be developed in an open and public process inviting AFMC, AFP4, LMTAS, the EPA, TNRCC, and interested stakeholder participants. The initial stakeholder meeting will be held on Thursday November 20, 1997, from 8:00 a.m.-5:00 p.m. at the Green Oaks Inn, Fort Worth, Texas. Stakeholders who believe that they may be affected by or are interested in AFP4's proposal are invited to attend. At the conclusion of this FPA development process, a proposed final FPA will be presented to the EPA and TNRCC for adoption. EPA will then provide additional public notice of the proposed FPA and allow interested persons an opportunity for review and comment.
