EPA in coordination with HHS shall identify pests of significant public health importance.

  • April 2000: OPP issued for public comment PR Notice "Pests of Significant Public Health Importance."

  • Public comment period recently extended 60 days at the request of several stakeholders.
  • Comment ends July 30, 2000.

EPA shall consult with HHS prior to taking final action to suspend registration under Section 3(c)(2)(B), or cancel a registration under Sections 4, 6(e), or 6(f).

  • OPP has developed a process in coordination with HHS to consult before taking action.

  • OPP has consulted with HHS on 11 chemicals, including the organophosphates (OPs) and carbamates: Fenthion, Chlorpyrifos, Temephos, Malathion, Isofenphos, Naled, Isazofos, Methyl Parathion, Bendiocarb, Niclosamide, Propetamphos.

EPA in coordination with HHS shall implement programs to improve and facilitate the safe and necessary use of chemical, biological, and other methods to combat and control such pests of public health importance.

  • Mandate achieved through the Pesticide Environmental Stewardship Program (PESP), meetings with stakeholders, coordination with states, and on-going activities with CDC.

  • PESP promotes IPM and reduction in the use of chemicals. The Department of Defense, CDC, American Mosquito Control Association are a few examples of PESP partners working with EPA.
  • OPHO and staff serve on the Federal West Nile Virus Coordinating Committee, chaired by CDC.
  • OPP developed mosquito control and chemical fact sheets for states combating West Nile Virus.

EPA shall exempt any public health pesticide from the payment of a re-registration fee or registration maintenance fee...if EPA determines in consultation with HHS that the economic return to the registrant from sales of the pesticide does not support the registration or re-registration of the pesticide.

  • Public Health Steering Committee will review such requests.

  • The criteria for what defines a public health pesticide is delineated in the Pest List PR Notice.
  • EPA has not received requests for waiver of the re-registration fee.
  • Instructions and criteria for registration maintenance fee waiver requests will be included in the Maintenance Fee Billing Package sent to all registrants in November 2000.
  • There have been two requests for waiver of maintenance fees. One granted and one was denied.

EPA shall...assure the expedited processing review of any application that proposes the initial or amended registration of an end use pesticide that, if registered as proposed, would be used for a public health pesticide.

  • There have been no requests to date.

  • Public Health Steering Committee currently exploring options including revising the priority ranking procedures and/or establishing ad hoc group to determine whether the pesticide application is a public health pesticide warranting expedited review.

HHS shall make arrangements for the conduct of studies...if EPA and HHS determine that the benefits of continued use warrant a commitment by HHS to conduct the studies for re-registration or continued registration. EPA shall amend the 3(c)(2)(B) notice to allow for reasonable time periods for submission of data by HHS before taking final action.

  • EPA has provided HHS with general potential data gap information and estimated costs for conducting studies to help facilitate their establishment of a testing program.

  • EPA facilitated discussions between HHS and IR-4 Program staff at Rutgers who currently conduct testing. HHS funding issue-no monies currently allotted to HHS to conduct potential studies.
  • EPA has not yet been faced with a case warranting a commitment by HHS to conduct studies.
  • However, the EPA and CDC Consultative Process (SOP) has been developed in case of need.
