Tolerance Exemption Amended - This regulation amends the existing exemption from the requirement of a tolerance for residues of Lepidopteran Pheromones to include use as a "post-harvest treatment" on all stored food commodities. Bedoukian Research, Inc. submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of biochemicals classified as lepidopteran pheromones.

New Active Ingredients Approved - (Z)-9-dodecenyl acetate and (E)-9-dodecenyl acetate were approved on 5/20/99 for use as timed release microencapsulated pheromone concentrate used for mating disruption of the Eastern Pine Shoot Borer Moth in forests and woodlands. The technical product (52991-10) was from Bedoukian Research Inc. of Danbury CT and the end-use product (10350-46) was from 3M/Animal Care Products of St. Paul MN

Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the microbial antifungal agent Aspergillus flavus AF36, a non-aflatoxin-producing member of the naturally-occurring genus of fungi Aspergillus, in or on the food/feed commodity cotton, when the pesticide is used according to its label instructions as a prebloom application. The Interregional Research Project Number 4 (IR-4), on behalf of the Arizona Cotton Research and Protection Council, submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Aspergillus flavus AF36 in or on cotton and its food/feed commodities.

EPA issued a notice, published in the Federal Register of January 28, 2004 (69 FR 4133-4135) (FRL-7339-9), which announced that Bedoukian Research, Inc. of Danbury CT, had submitted an application to register the pesticide product, Bedoukian (Z)-6-Heneicosen-11-one Technical Pheromone, Pheromone/attractant (EPA File Symbol 52991-RT), containing (Z)-6-Heneicosen-11-one. This product was not previously registered. The application was approved on January 21, 2005, as Bedoukian (Z)-6-Heneicosen-11-one Technical Pheromone (EPA Registration Number 52991-17) for incorporation into end-use products, and not for direct treatment of pest.

>New Active Ingredient Approval - EPA issued a notice, published in the FR on 12/13/00 which announced that Bedoukian Research, Inc. of Danbury, CT 06810-4192, had submitted an application to register the pesticide product, Bedoukian Z-11-Hexadecenyl Acetate Technical Pheromone, a lepidopteran pheromone fungicide, containing the active ingredient Z-11-hexadecenyl acetate. This product was not previously registered. The application (EPA Registration Number 52991-15) was approved on August 31, 2001, for use in the incorporation into end-use products intended for agricultural application. This product is not for direct treatment of pests.

Conditional Approval of Active Ingredient - EPA issued a notice, published in the Federal Register of December 15, 2005 (70 FR 74316) (FRL-7749-7), which announced that Suterra, LLC of Bend, OR, had submitted an application to conditionally register the pesticide product, Checkmate BAW Technical Pheromone, biochemical pheromone (attractant) for mating disruption of the Beet Armyworm Moth (Spodoptera exigua) (EPA File Symbol 56336-UT), containing (Z,E)-9,12-tetradecadien-1-yl acetate at 87.66% an active ingredient not included in any previously registered product. The application(s) were conditionally approved on March 13, 2006, as listed below:
1. Checkmate BAW Technical Pheromone. For manufacturing use only. EPA Reg. No. 56336-47.
2. Checkmate BAW-F. End use product for direct application to the Beet Armyworm Moth. EPA Reg. No. 56336-43.
