The Acta Group  of Washington D.C., on behalf of Circle One Global of Shellman, GA ) proposes to amend the exemptions from tolerances for residues of the microbial pesticide, Aspergillus flavus NRRL 21882 , in or on the food commodity corn.

6/30/04 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the microbial active ingredient Aspergillus flavus NRRL 21882 on peanuts when applied/used in accordance with label directions. Circle One of Shellman, GA submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Aspergillus flavus NRRL 21882 on peanuts.

  1. File Symbol: 75624-R. Applicant: Circle One Global, Inc. of Shellman, GA. Product name: Aspergillus flavus NRRL 21882. Antifungal agent. Active ingredient: Aspergillus flavus NRRL 21882 at 100%. Proposed classification/Use: A microbial pesticide; a manufacturing use product to be formulated into end-use products to displace aflatoxin-producing Aspergillus flavus from peanuts.


  2. File Symbol: 75624-E. Applicant: Circle One Global, Inc. Product name: Afla Guard. Antifungal agent. Active ingredient: Aspergillus flavus NRRL 21882 at 0.002%. Proposed classification/Use: A microbial pesticide; end-use product to displace aflatoxin-producing Aspergillus flavus from peanuts.
3/17/04 Petition for Tolerance Exemption - EPA has received a pesticide petition, 4F6815, from Circle One Global, Inc. of Shellman, GA to amend 40 CFR part 180 to establish an exemption from the requirement of a tolerance for the microbial pesticide Aspergillus flavus NRRL 21882 on peanuts.

6/11/03 Experimental Use Permit Application - Circle One Global, Inc., One Arthur St., P.O. Box 28, Shellman, GA 39886-0028, has applied for an EUP for field testing of a new end-use product of a microbial pesticide containing the active ingredient, Aspergillus flavus NRRL 21882, in a non-crop destruct program. The product is to be ground applied and is a granular formulation. The requested EUP is for a total of 5,000 acres to be treated for a total application of 10 lbs of the active ingredient. Application of the pesticide is proposed to reduce aflatoxin-producing colonies of Aspergillus flavus on the crop and in the soil by competitive displacement. Testing of 100 lbs of the active ingredient will occur in three States: Alabama, Florida, and Georgia.
