12/22/04 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the microbial pesticide Bacillus pumilus GB34 when used as a seed treatment in or on all food commodities. An exemption is also granted for such residues on treated but unplanted soybean seeds. Gustafson LLC submitted a petition to EPA to amend and expand an existing exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus pumilus GB34.
3/3/04 Petition for Tolerance Exemption - EPA has received a pesticide petition 1F6344 from Gustafson LLC of Plano TX, to amend 40 CFR part 180 to establish an exemption from the requirement of a tolerance for the microbial pesticide Bacillus pumilus GB34 when used as a seed treatment in or on all food commodities and on soybeans after harvest.

5/30/03 New Active Ingredient Approval - EPA issued a notice, published in the Federal Register of December 31, 2001 , which announced that Gustafson LLC, 1400 Preston Road, Suite 400, Plano, TX 75093, had submitted applications to register the following two pesticide products: GB34 Concentrate Biological Fungicide, fungicide (EPA File Symbol 7501- ROR) and GB34 Technical Biological Fungicide (EPA File Symbol 7501- ROE), containing Bacillus pumilus GB34 at 0.28% and 13.8%, respectively. These products were not previously registered. The applications were approved on March 13, 2003, as GB34 Concentrate Biological Fungicide (EPA Registration Number 7501-191); for use as a treatment for soybeans for suppression of root diseases caused by Rhizoctonia and Fusarium and GB34 Technical Biological Fungicide (EPA Registration Number 7501-192) for reformulating into end-use fungicide products.
4/2/03 Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the Bacillus pumilus GB 34 when used as a seed treatment in or on soybeans and soybeans after harvest. Gustafson LLC submitted a petition to EPA requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Bacillus pumilus GB 34.

4/10/02 Experimental Use Permits Granted - EPA has issued the following EUP:     7501-EUP-3. Issuance. Gustafson LLC, 1400 Preston Road, Suite 400, Plano, TX 75093. This EUP allows the use of 2.290 grams of the technical active ingredient contained in 114.54 grams concentrate of the fungicide Bacillus pumilus GB 34 to treat the soybean seed to be planted on 67 acres to evaluate the control of the fungal diseases Rhizoctonia and Fusarium. The program is authorized only in the States of Arizona, Illinois, Indiana, Iowa, Kansas, Louisiana, Maryland, Massachusetts, Minnesota, Missouri, Nebraska, Ohio, Oklahoma, Texas, and Wisconsin. The EUP is effective from March 1, 2002 to February 28, 2003.
