Tolerance Exemption Established - This regulation establishes an exemption from the requirement of a tolerance for residues of the microbial antifungal agent Aspergillus flavus AF36, a non-aflatoxin-producing member of the naturally-occurring genus of fungi Aspergillus, in or on the food/feed commodity cotton, when the pesticide is used according to its label instructions as a prebloom application. The Interregional Research Project Number 4 (IR-4), on behalf of the Arizona Cotton Research and Protection Council, submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of Aspergillus flavus AF36 in or on cotton and its food/feed commodities

Application for New Active Ingredient Registration - EPA received an application to register a pesticide product containing a new active ingredient not included in any previously registered product. Notice of receipt of this application does not imply a decision by the Agency on the application. Interregional Research Project Number 4 (IR-4), New Jersey Agricultural Experiment Station, Technology Center of New Jersey on behalf of the Arizona Cotton Research and Protection Council, submitted an application, to register a new active ingredient Aspergillus flavus AF36, (EPA File Symbol 71693-R), a non- aflatoxin-producing strain of Aspergillus flavus, to reduce aflatoxin contamination on cotton. Aspergillus flavus AF36 occurs naturally in Arizona and Texas.

Tolerance Exemption Proposal - EPA has received a pesticide petition (PP 8E5001) from Interregional Research Project Number 4 (IR-4), New Jersey Agricultural Experiment Station, Technology Center on behalf of the Arizona Cotton Research and Protection Council proposing to amend 40 CFR 180.1206 by establishing an amendment/ expansion of an existing tolerance exemption for the microbial pesticide Aspergillus flavus AF36 in or on the food and feed commodity cotton and its by products. The pesticide is currently being used in certain counties in the States of Arizona and Texas under an Experimental Use Permit (EPA Reg. No. 69224-EUP-1). The current submission proposes to establish a permanent exemption from tolerance for residues of Aspergillus flavus AF36 on cotton and its byproducts.

Temporary Tolerance Extension Approval - Aspergillus flavus AF36. This regulation amends an existing temporary exemption from the requirement of a tolerance for residues of the atoxigenic microbial pesticide, Aspergillus flavus AF36 on cotton consistent with the Experimental Use Permit 69224-EUP-1. Interregional Research Project Number 4 (IR-4), on behalf of the USDA/ARS Southern Regional Research Center, submitted a petition to EPA requesting the temporary tolerance exemption amendment. This regulation eliminates the need to establish a maximum permissible level for residues of Aspergillus flavus AF36. The temporary tolerance exemption will expire on December 30, 2004.

Application for Temporary Tolerance Extension - EPA has received an amended pesticide petition PP 5E4575 from IR-4, proposing to extend the temporary exemption from tolerance for residues of the non-aflatoxin-producing microbial pesticide Aspergillus flavus AF 36 in/on cotton. This amended petition is filed by IR-4, New Jersey Agricultural Experiment Station, Technology Center of New Jersey, Technology Centre of New Jersey, North Brunswick, NJ  on behalf of the USDA/ARS Southern Regional Center, New Orleans, LA. The amendment seeks to extend the current temporary exemption from tolerance to include cotton treated with A. flavus AF36 in 9 counties in Texas.

Extension of Temporary Exemption From the Requirement of a Tolerance - This regulation extends a temporary exemption from the requirement of a tolerance for residues of the biological Aspergillus flavus AF36, (A. flavus) a non-aflatoxin producing strain of A. flavus, on cotton when applied or used as aerial pre-bloom applications to cotton in specified counties of Arizona. The Interregional Research Project Number 4 (IR-4), New Jersey Agricultural Experiment Station, Technology Center of New Jersey, Rutgers University of North Brunswick, NJ , submitted an amended petition to EPA  requesting the temporary exemption. This regulation eliminates the need to establish a maximum permissible level for residues of Aspergillus flavus AF36. The temporary tolerance exemption will expire on December 30, 2003
