Objections to a Pesticide Tolerance
Under section 408(g)(2)(A) of the Federal Food Drug and Cosmetic Act, any person may file objections with EPA within 60 days of issuance of a final tolerance regulation. Under EPA regulations, EPA must publish an order setting forth its determination on each of the objections. Such order must contain EPA's reasons for its determination. If, based on the objections, EPA determines that the tolerance regulation should be modified or revoked, EPA will publish by order any revisions to the regulation.
EPA has received the following objections to tolerances since January 1, 2002.
- The Natural Resources Defense Council (NRDC) filed objections
on February 25, 2002, March 19, 2002, May 7, 2002, and May
20, 2002, with EPA regarding final rules establishing tolerances
under section 408 of the Federal Food, Drug, and Cosmetic Act
(FFDCA)for the following pesticides on the crops noted. NRDC's
objections concern a number of issues under section 408 of the
FFDCA including the additional 10X safety factor for the protection
of infants and children and aggregate exposure to pesticide chemical
residues. This document seeks comment on the NRDC objections.
EPA must receive comments, identified by docket ID number OPP-2002-0057,
on or before September 17, 2002. The Federal Register notice requesting
comment on items (1.) through (8.) below was published on June
19, 2002.
