Pesticide News Story: Extension of Public Comment Period on Proposed Stipulated Injunction Involving Pesticides and 11 Species Listed as Threatened or Endangered Under the Endangered Species Act

On July 1, 2009, EPA published a Notice in the Federal Register opening a 15-day comment period on a proposed stipulated injunction that would resolve litigation brought against EPA under the Endangered Species Act.  This proposed stipulated injunction, if entered by the U.S. District Court for the Northern District of California, would resolve a lawsuit brought against EPA by the Center for Biological Diversity (Center for Biological Diversity v. EPA, No. C 07-02794 JCS (N.D.Cal.)).

The comment period and public docket for this action are scheduled to close on July 16, 2009.  However, based on comments received, EPA will be publishing another Federal Register Notice that will re-open the comment period for an additional 30 days from the original closing date.  This re-opening will extend the public’s opportunity to develop meaningful comments on the proposed stipulated injunction until August 17, 2009.  EPA anticipates the Federal Register Notice re-opening the comment period will be published on July 22, 2009, after which the electronic docket will be re-opened to receive public comment.  At that time, comments may be submitted as indicated in the Federal Register Notice.
