Pesticide News Story: Pesticide Inert Ingredients — Information on Certain Revoked Exemptions

On Friday, November 2, 2007, EPA published information in the Federal Registerabout industry’s interest in regaining the use of a number of surfactant chemicals used as inert ingredients in pesticide products. Tolerance exemptions for these chemicals were revoked (Federal Register, August 9, 2006, 71 FR 45415) because of insufficient data. The revocations will become effective on August 9, 2008, unless data are submitted to EPA that are adequate to support reinstatement of the tolerance exemptions. EPA has received notice from various companies of their intention to submit data to support the reinstatement of a number of inert ingredient tolerance exemptions. After review of the submitted data, EPA will conduct rulemaking to establish new tolerance exemptions where appropriate.

In the interest of keeping stakeholders informed about activities that may affect these revoked tolerance exemptions, EPA is identifying the tolerance exemptions industry indicates they will support. The information provided in this notice does not guarantee or in any way bind the Agency to reinstate any tolerance exemptions, establish new tolerance exemptions, or grant extensions to expiring tolerance exemptions. EPA cannot guarantee that the parties will, in fact, submit any data or that the results of the data will allow for reinstatement (or new tolerance exemption) under FFDCA section 408(c)(2). EPA recommends that anyone with an interest in this issue contact the chemical suppliers to confirm their plans for supporting a tolerance exemption.
