OVER 1400 PESTICIDE PRODUCTS CANCELLED FOR

FAILURE TO PAY l994 MAINTENANCE FEES

EPA is cancelling approximately l,480 pesticide product registrations for nonpayment of the annual registration maintenance fee which was due on Jan. l5, l994. Late payments were accepted until April l5. The l988 Amendments to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), require that maintenance fees be paid each year for every registered pesticide product. Most of the cancellations being announced are no longer in production and are not expected to affect pesticide markets or users. The Agency has waived the fee for 42 minor agricultural use registrations at the request of the registrants. In addition, EPA is withholding the cancellation of 11 other registrations for 90 days to allow time for the registrant or other parties to support these registrations. EPA is also deferring for 90 days the cancellation of five active ingredients which will totally disappear from the market unless the registrant or other affected persons make arrangements to continue registrations: kerosene (trade name Maxipreme) and dinitor-N,N-dipropylcumidene (PAARLAN EC) which are used in agriculture; isovaleryl-1,3 indandione, calcium salt (TRAC Anticoagulant Tracking Powder Kills Rats and Mice) which is a rodenticide; isooctyl(2-octyl) 2,4-dichlorophenoxy-acetate (Lo-Vol 2D/2DP Turf Care Herbicide) used as a herbicide on turf grass; and, cyclododecyl-2,6 dimethylimorpholine acetate (MILBAN) used on ornamental plants. The l990 Farm Bill amended FIFRA to allow EPA to reduce or waive the maintenance fees for minor agricultural use pesticides when the Agency determines that the fee would likely cause a significant impact on the availability of alternatives pesticides. The cancellation orders generally permit registrants to continue to sell and distribute existing stocks of cancelled products until the due date of the next annual registration maintenance fee, Jan. l5, l995. Existing stocks in the hands of dealers or users, can generally be distributed, sold or used legally until the stocks are depleted.
