EPA ISSUES REGULATIONS FOR NON-MUNICIPAL,=20 NON-HAZARDOUS WASTE DISPOSAL UNITS

The Resource Conservation and Recovery Act requires EPA to revise the= =20
existing standards for non-hazardous waste disposal facilities that= =20
may receive conditionally exempt small quantity generators (CESQG)= =20
waste or household hazardous waste. Although non-municipal, nonhazardous units pose comparatively small risks, EPA is taking action= =20
to satisfy the statutory mandate of RCRA section 4010(c). These=20 regulations require any new or existing non-municipal, non-hazardous= =20
waste disposal unit that receives CESQG waste to comply with new=20 technical standards. Units that receive CESQG hazardous waste will b= e=20
subject to location restrictions, groundwater monitoring requirements= =20
and corrective action standards. Three types of facilities that may= =20
receive CESQG waste may be affected by this rule:

=B7 Off-site commercial industrial units, which generally are=20 stringently designed and monitored; =B7 Industrial units that may be co-disposing of CESQG waste with= =20
industrial, non-hazardous waste on site; and =B7 Construction and demolition waste units that receive CESQG= =20
hazardous waste.

This regulation uses the Municipal Solid Waste Landfill Criteria (Par= t=20
258) as a baseline for the technical standards. The criteria are= =20
standards that provide adequate environmental protection and can be= =20
applied to non-municipal, non-hazardous waste disposal units that= =20
receive CESQG waste. The criteria incorporates substantial=20 flexibility for EPA-approved states to allow owners/operators to meet= =20
