EPA orders Local Developer, Michael Achen and CMK Investments to stop filling Wetlands in Battle Ground, Washington

The U.S. Environmental Protection Agency (EPA) has ordered Michael Achen and CMK Investments to stop all actions that would involve the filling of wetlands on the proposed Rasmussen Business Park located off of State Route 503 in Battle Ground, Washington.

Mr. Achen and CMK Investments violated the Clean Water Act (CWA) by failing to obtain a U.S. Army Corps of Engineers (Corps) CWA permit prior to conducting mechanical land-clearing work at the proposed Rasmussen Business Park in August 2004.

Because Mr. Achen had previously violated the CWA in the Battle Ground area, EPA took over federal responsibility for investigating the August 2004 CWA violation.

During EPA's investigation of the August 2004 violation, the Corps notified EPA that Mr. Achen had once again conducted land-clearing operations at the site in July 2005, further impacting the wetlands on the site.

EPA has issued a Compliance Order to Mr. Achen and CMK Investments LLC that directs Mr. Achen and his company to stop all unauthorized work on the site and initiate a restoration effort to restore approximately 6.5 acres of wetlands impacted by their unauthorized actions.
